Right now I'm on a B1/B2 visa but designed to leave the U.S in like 2 weeks from now to proceed with the consular processing route for the immigrant spouse visa.

My question is: Can my wife, or should she, add me on her W-2 form as a dependent to show our con-mingling resources even though i don't work as of now??? would that be possible as I am not a green-card holder nor a U.S citizen and does not have a social security number??

Plus, we're going to use her parents as our co-sponsor for the affidavit of support (i-864) would that have any negative effect on our case?

You don't list dependents names on the W2 form. Simply a number of dependents (deductions) you wish to claim. Its used to determine how much income tax is deducted from your paycheck.

So I don't think that is going to help you.

yes, it does help

both names are listed on a joint tax return

at the time she does taxes, send in the form W-7 requesting ITIN for you /needs copy of birth certificate and translation and your marriage licence

having this not only shows co mingle funds but with your POA she can add you to her bank account helpiing your cause

I did this / my husband was not allowed debit card till he came but his name was on bank statements and with this i could add him also to 1 utlility billl / the water bill

actually saw that a foreign spouse can apply for a SS card when still in native land

All this helped me

An IRS Form W-2 is a Wage and Tax Statement, there is no place to insert a dependents name. Besides, if you are a married couple, you do not list your spouse as a dependent on your IRS Form 1040, US Individual Income Tax Return. The spouse's name and SSN is listed on line 2 of the Form 1040. Refer to page 12 of the Form 1040 instructions for more information about SSNs and ITINs for alien spouses. From a tax perspective, most couples file a Married Filing Jointly (MFJ) tax return, that would be reflected on Line 6 of the Form 1040.

Good luck on your immigration journey.

Your wife can't add anything to a W-2 form. That is something an employer issues telling the amount of wages paid for the whole tax year. It has nothing to do with a spouse or dependents. It is the summary of her wages.

A W-4 form is something she fills out saying if she is married, has kids, etc to determine what is held out of her paycheck. She can change hers to married, but it isn't much toward comi going proof. A joint bank account or joint tax return is co-mingling.

Before you leave, try to find an IRS office to get your passport verified so you can apply for an ITIN (Individual Taxpayer Identification Number) then she can file a joint tax return with you for 2015. Otherwise she would need to mail your passport off to Austin with her tax return...actual passport, not photocopy. You probably need to have your passport with you instead of mailing it somewhere.

The only person named on the W-2 form is the employee. No other name can be "added" by anybody.
