My fiance and I dont plan to live in the USA after marriage.

We soon have our K1 visa interview and are wondering if it is ok to state that after we get married we dont plan to stay in the USA. We want to get married in the states so my family and friends can see the wedding. Then move back to India together and have a wedding there as well. Will stating this put us at risk of getting declined the K1 visa?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, I know that. But there are so many problems with marrying on a tourist visa. The fiance visa seemed like a more stable way to get our visa. We already have our interview appointment set in place. Do you think it would harm our chances if we mentioned that we plan to live in India? We will also include that we intend to marry in America so my friends and family can see me get married.

Yes, why would you jeopardize obtaining the visa by stating that you intend to not comply with it's intentions, immigration to the US and maintaining permanent residence there?

But we have seen some folks do exactly what you are intending because there is no chance of obtaining a visitor's visa to come to the US just to marry and then leave.

We will also include that we intend to marry in America so my friends and family can see me get married.

Too much information. Just use the Example Form which states that you intend to marry within 90 days of entry. Period.

I guess that's how K-1 Visa was for in the first place. Staying and living in the US will just be an option. Since you are marrying a US citizen, the state law allows its citizen to bring their fiancé or fiancée and marry in the US. Allowing the partner entry and the option to stay or not after the marriage.

yeah K1 is mostly for people intending to stay within the U.S. and establish permanent residency. Otherwise should just apply for a tourist visa... yet if your real intention is to marry in the U.S., it could be considered lying. So yeah probably K1 is the best option. Anyway it's not like you're lying, you are going to get married within 90 days after she arrives in the U.S.

Other folk have done exactly that, whats written in post #1. Adjustment of status is a path to a greencard; no need to go through with the aos based on your plans.

No, i would not tell the co your plans, except to mention the future marriage date in the usa.

At least with the k-1 visa the letter of intent you sign your name too only mentions marrying the individual, not staying in the U.S. forever.

I'm in a sort of similar situation. We aren't planning on leaving immediately after getting married since I have a few more years of school to go but both of us are interested in the possibility of moving to another part of the world eventually. I am curious to see how you end up figuring things out! I assume the process is probably different after you file for AOS like we will have but still!

There is nothing illegal about marrying while on a tourist visa, as long as the foreign spouse then returns home within the timeframe of the tourist visa. Many people doing the CR/IR-1 visa get married while in the US on a tourist visa or on the VWP. :) And in OP's case, this might have been the faster option, since they're not planning on living in the US anyway.

OP, prepare yourself for the potential question of "where do you intend to live".
