CR1 Eligibility question - no record but admitted to drug use at border

Hey guys!

My wife and I got married a few months ago. We are looking at doing a CR1 visa application and moving to the US.

The unfortunate part is that when we were dating we crossed the border together. This drew up a bunch of flags, secondary inspection ect.. they ended up reading my journal I'd left in my truck where I talked about past drug use. In an interview I then addmitted to having used LSD once mushrooms twice and marijuanna under 5 times, this all I told them was not within the last three years. I do however have no criminal record.. just admitting to the officer of my use, but I believe they take this the same as if I had been charged.

My question is I know that an immigrant wavier is not availible for drug crimes. Has anyone ever been approved with any history like this?

You were a user, and not arrested for crimes related to drugs so yes, there is a chance.

Often in cases like that, you do not need an actual waiver, but your case, after the embassy interview, would be held for a year while you undergo random drug testing. If clear, the visa will then issued a year later. There have even been cases where visas were issued right away if the drug use was minor and a long time ago, but since you used three different drugs, that may be less likely.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You were a user, and not arrested for crimes related to drugs so yes, there is a chance.

Every case is different, but yes, we have had cases on here before where beneficiaries admitted to drug use during prior work our tourist visa interviews, or were caught with small amounts of drugs while vacationing in the USA, and later successfully got a spousal visa.

Eighteen years in the US and I still don't understand Velveeta, TV ads for prescription drugs, only getting 2 weeks paid vacation, or why anyone believes anything they see on Fox "News".

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Please be sure to be consistent at the embassy interview , the worst can be a pause of a yr (although that 3 drugs)

Again :People entering the US clear Texts, Wattsapp msgs, & mail incriminating journals , letters & papers ahead B4 that

will cause you probs, also delete dirty pics that can be construed as Porn

Well... At least it feels good to see I'm not the first one or the last one admitting drug use once as a teen. I'll have my interview tomorrow and this has been a big deal to me... I know every case is different but could anyone share their experience at the interview after they admitted drug use at the medical? Any hope would be appreciated.

My interview went very well!! I was all scared about the answer I gave while at the medical but at the interview I was asked a couple of questions, and then two minutes later I hear "your visa was approved". I guess it didn't hurt me to tell the truth but if I could relive the experience I would have lied, just to have peace of mind, as ironic as it sounds.
