Do I look like a Work or Business visitor? [merged threads]

I'm an engineer ,I have been building electronic hardware and programming applications for US, California based START-UP company (note I have never been to US), now they have incorporated the company under California laws and I have been put as a CTO (Chief Technology Officer) under the heading "election of officers" in the incorporation document of the company and in addition to that I have been allotted shares too!, Now I need to goto US to attend investor meetings etc, BUT I'm confused about whether I'm a B-1 Business VISA seeker or a Work VISA seeker ?

Kindly please advise.

I'm going there for meetings,I cannot work there as there is no lab setup there. I have to use my lab to programme and develop prototypes.

In addition to that the letteri have for invitation clearly lists meetings with logic PD, INVESTORS and production houses.

Do I now fully qualify as the B1?

No idea if you qualify for a B, you activities as described fall with the scope of one.

I invested nothing I'm the inventor of the device based on which this company is based on.

They selected me as the CTO because I qualify and knew the technology involved and they saw my work from an already employing US citizen who puts up in Laos.

I already do tele conferences but now ppl want to see me

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

They are the partners, the business individuals who made this company with capital input and brought all the resources together. One of them is the CEO other the coo + vice President and other is the director,yet another one is the industrial designer.

The meetings are suppose to take place for a period of 25 days.

The reasons the consular may believe that I will return are as follows:

1. I have a 5 year old sole proprietorship firm.

2. I'm the director of EmagesPro Solutions pvt. Ltd.

3. I'm a regular consultant for a company in Vietnam! And can show this with payment contracts.

While a B1 is the right category, the CO will have to be convinced that this trip is not to have you work under the guise of 'knowledge transfer', which has been used and abused so many times that no CO with more than ten minutes of experience will or should fall for it...

so according to you which work VISA is the right one for me?

or what should my ppl there in states do to sponsor me?

they were talking about that if I had $250,000 to invest in the company then I can get an investor VISA which is a sure shot path to US, is that true?

well I will say one thing here, the much I have read says that i cannot get the H1B for this company BCZ an H1B can't work and own shares in the same company, which means straightaway that A work VISA isn't an option for me so my best bet remains the B-2, business VISA, since I own shares meaning, I own the company and am not receiving any remuneration for the job as im being paid in the form of shares(owning the company).
