Small mistake in petitioner's name (and a couple more questions)

Hey everyone!Here's my issue:

Every time I've called NVC, they were always polite even when they couldn't do much. Today I called twice and both ladies were rude and unhelpful. (both in option 7 on the phone)

The main thing is that although in all other instances my husband's name is spelled correctly when I logged in to our case for the first time I noticed that there was a small mistake in his first name.Instead of Michael it's spelled as "Mcihael". I called NVC right away and they said that although they're not able yet to access my case,it wasn't a big mistake and they would be able to fix it once the case was done editing.

I called multiple times since then (mostly to give them our email addresses) and every time they told me the same thing.The last time before today the lady even noted down the emails and name issue to fix once it was possible.She also told me it was ok to pay any fees and fill in forms.So I completed the DS-261 and my husband paid the AOS fee.

So I called today to ask if they've added the emails to our case,if they've corrected the name,if our DS-261 has been reviewed and approximately when the IV fee would be invoiced so we could pay it.

The lady said they couldn't add any email info,that the names can not change unless he sends a copy of his passport (I was told 3 times that that would not be necessary and told her so- she simply said they were all wrong),she said I need to wait 42 days (!) for DS-261 to be reviewed and that after that IV would be available for payment.

Second lady said the same and even seemed to know exactly what I was going to ask since she was answering before I was finishing my questions. They were both very rude and almost sarcastic.

Sorry for the long rant but after waiting for so many months and spending so much money just to be with my husband you would expect people would treat you with respect.

Any help would be greatly appreciated!!

Sorry to hear of the hassle. Not sure if it is a legal thing but hardly will they accept fault. I assume the name was correct on the I-130 petition. Unfortunately, someone had a run in similar to this but at a later stage in the process and it resulted in a pretty significant delays with processing at the NVC.

Ultimately, you may have to send what they requested. I would suggest that you send all of that when you send in your AOS and Civil documents. In one package following the suggestion in the guide that you are probably familiar with. If not, see here: http://www.visajourney.com/wiki/index.php/NVC_Process

I think a letter describing the necessary change to be made will be helpful.

As an additional precautionary measure you could request to speak with a supervisor and see if they may have an easier way to correct their error.

I just really don't want to delay the case cause once the Holidays roll in it will be worse..

Do you know how long I have to wait for the DS-261 to be added to the case so that IV will finally be invoiced? Also once we sent the IV and AOS package (you were right,I am familiar with the guide :) )how long will it take for them to complete the case if everything is ok and we get no checklists?

You are welcome.

After completing the DS-261, now you will have to call and have one of the agents confirm it. That will unlock the IV fee in a timely manner. That can be a challenge, some don't want to do it too quickly. Some have found that saying: I completed the DS-261 but not sure if everything is ok, could you confirm that I did it correctly may result in the agent being more helpful. You can call again if the agent you speak to is not helpful.

I think after sending in your document, and barring any snafus then from the day they enter it into their system (scan date) they are suppose to review your documents within 30 days. Hopefully you will get case complete within 30 days.
