All,

I would appreciate any help! Im from Turkey. I was denied a student visa twice already . Fist one was 2010, I was told I was not qualified for the visa.

Second time was in 2012, CO told me. My application was complete but I did not have enough money for the visa, whether or not if I had any assets. Of course I did not have any. He asked me I should come back and apply again when I have enough money. Of course , I never went back because for various reasons.

Now, I want to go and visit family in USA. I want to apply for tourist visa ideally and I have saved up enough money.

The facts;

Most of my family lives in the states except my parents. DC, VA, CA. Im from Turkey. I want to come as a tourist . I have some family members ( uncles and ante) that died here in CA, I would like to pay a visit to their graveyard,. My parents have been to America and they live in Turkey now. Im single and live with my parents. I work part time. I was born in 1985

Should I apply for a tourist visa or student visa? I prefer tourist visa

Knowing my situation , What do I need to do secure the tourist visa this time?

Whit a visitor visa application, you reasons for coming to the US are not important because they can not help you overcome the presumption that all visa applicants intend to stay in the US illegally. To get the visitor visa, you need to show the reasons you will return to Turkey if you are permitted to visit the US.

You are a 30 years old man living with your parents and working a part time job. You are unlikely to get a visitor visa.

If you have the educational background and get accepted to a US school, then you can apply for a student visa.

You need to decide if you want to visit the US or go to school here.

If you are pursuing any visa to come to the US, then it will be obvious that you are desperate to get to the US and this will affect your application.

Why would you apply for a student visa? Why do you want to study there as you don't seem to be currently studying in Turkey?

And you already said you want to go as a tourist.

Stop changing your ideas just to find a way to enter the US.

My advice would be to find a full time job and strengthen your ties to Turkey.

You can apply for a student visa if you have been accepted to an accredited U.S. institution, intend to study full-time, and have funds to pay for the school and all living expenses. You cannot get a student visa without a college/university acceptence letter, a form I-20 issued by that school, intent to study full-time and proof of funds.

It sounds like you want to visit the U.S., not study here.

To visit the U.S., you need a tourist visa.

You qualify for a tourist visa if your intent is to visit the U.S. for less than 180 days. To get the visa, you will need to show that you only intend to visit - Usually, the consular officers want to see that you have enough money to pay for your vacation without working in the U.S., that you have a job in Turkey, or that you're in school - Anything that shows that you have a life in Turkey and that you intend to return to Turkey after your vacation is over.
