no taxes filed

We are at the NVC stage and I am working on the AOS. I haven't filed taxes the last three years because of no income. How can I prove that I wasn't required to file. I was a full time student and have transcripts, but there are a couple of gaps. I have been graduated for 1-1/2 years and have been taking care of my son full time since. I suppose I can include the monthly statements from my US bank account along with my transcripts, but will this be enough? I also have a foreign bank account, but requesting past statements takes time and is expensive.

I am worried that this is the one hangup that will get me a checklist....any suggestions?

Timeline

Following the I-864 instructions you should submit a signed statement that you were not required to submit tax returns for years 20xx - 20yy because you earned less than the filing requirement in each of those years.

If you have current and continuing income that meets the requirement and/or assets that meet the test then you are ok. if not, then you will need a joint sponsor. However you still submit an I-864 as the primary sponsor regardless of income.

Correct, however, the affidavit itself can serve as your signed statement, by hand writing across the tax return space, the following words. "Not required to file. Income below threshold." No other evidence or proof of not being required to file is required. You've also signed a G325a, indicating your employment status for the last five years, so they actually WILL put two and two together on this. No worries.
