Case file missing between NVC and Consulate

Hi everyone,

I was wondering if anyone might have helpful advice for me.

In a nutshell, the NVC finished processing my husband's case in September. On the 17th of September, we requested an expedited interview at the Sydney Consulate on the grounds that our young kids (6, 4 and 2) are not adjusting well to life in the States without their father (the kids and I moved back to the US 2 months ago and they sob for him every single night). The expedite request was granted on the 21st of September. We were told the file would be released to the Sydney Consulate "immediately." Apparently "immediately" is NVC speak for "9 days later" because the file was released on the 30th.

The problem is that the Sydney Consulate says they don't have it. I called once again last night to confirm that the NVC did release the file on the 30th. The lady I spoke to on the phone told me that it would have been sent to them elecronically becuase everything we did was electronic, so it would have been sent electronically only- no paper copy in the mail at all. My husband spoke to the Sydney Consulate shortly after I spoke to the NVC. The Consulate said once again that they do not have the case file. Then they said that we would need to wait for at least another week before we should expect any sort of response because the NVC would have mailed a physical file to them in case the file would need to be mailed to New Zealand. That makes no sense to me, my husband is an Australian citizen and we have no ties to New Zealand, but that's what they said.

Anyone have any idea what this means? Is it possible that our case file is just simply lost in cyberspace? What do I do if it is? I don't understand how they can expedite our case due to mental health reasons for my children and myself and then continuously tell us to basically stop calling them and wait. I have also written to my Senator, I am not sure if that will help anything or not, but I thought it might be worth a shot.

Any advice would be appreciated.

They mailed a physical file? I guess they mailed it by hand not by email, which would explain the delay. I dont know much about NVC procedures I am just learning myself, but from your desription thats what I gather

That's where the confusion lies. The NVC say they sent it, and they sent it electronically only. The Sydney Consulate (the receiver, not the sender) say that it would have been a physical file sent through the postal system- they have not called the NVC to confirm this. I'm not sure why the Consulate would think that, especially when the NVC explicitly state that they emailed it, but the Consulate is expecting a physical package and is not willing to budge an inch or start any sort of search for the missing case files for a week or more becuase they are (mistakenly??) waiting on physical mail.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Aaaaw, the wonders of NVC... During our horrendous seven months and counting process at NVC, I've learnt to never trust what the NVC rep says on the phone. It seems they'll say or do anything to get you off the phone.

Here's a thought.... Knowing NVC, what if they sent your case electronically to the US embassy in New Zealand rather than Australia. Why don't you try and call the US embassy in Wellington and see if your case has accidentally been sent there? I know it's a long shot but you might as well try it, right?!

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning
