Timeline

So I arrived on a k1 Visa on July 10th and married my fiancee on July 22nd. I know the time limit to get married is 90 days but AFTER marriage, is the time limit the same?

We only have a week left and our sponsor doesn't have their paperwork together yet so any extra time would be useful. Should I send off the i-485 now to reach the USCIS by late next week?

I think hence you married within the 90 days window. You can take your time and file your paperwork anytime. You are not bound by any timeframe. Preparing the AOS packet is a sensitive process, so i will advise you to take your time and make sure everything is correct and accurate according to requirement.

Wait for the paperwork. There isn't a time limit to file AOS. However, you are not able to work or to travel outside the U.S. without the EAD card and AP. File all three at the same time as soon as you can. Better to wait then to get a denial because the spouse does not have enough income or assets.

On form i-485, under "Current USCUS Status" Do I put overstay? or K-1? and I'm guessing I put the "Expires on" date as October 7th (the date the k-1 visa was due to expire)

I think K1 would be the appropriate thing to put there. Experts will tell u if otherwise.

K1 visa holder.

The visa will have the expiration date on it.

In response to my same question at the time, an attorney recommended putting "K-1 entrant." Technically, the K-1 isn't being held any longer, because it was "dead upon arrival" at POE.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Firs of all you did not overstay anything so please do not put that anywhere in your paperwork.

The 90 days simply means you have to get married within 90 days, that's it. You can hold off filling AOS for 5 year and you would not be here illegally and many people put it off for years because of financial problems or whatever else.

Under current USCIS status you need to put "K1 - Visa Holder". Look at the example I-485 document on this website and you will see. At the USCIS they know when you enter the K1 expires so don't worry about that at all but they do want to see what you used to enter the US. So you might not want to put in "overstay" or anything else.

Hope this helps. It can be a confusing process i know, don't worry.

I arrived usa may 10 2014, i got married june 21st and i filled my aos on 8/24/2015. So i dont think u are going to have any problem i didnt receive nothing about that and i already did my biometrics. Good luck!!
