My wife has her GC, i am on H1b (in the US), my priority date is coming up in Oct for the I-485 AOS. I will be filing the I485 along with I864, I864A, I765 and G325.
I have a few ques. if someone can help me,
Q 1. My wife does not work but she will have to file the I-864 affidavit as my Sponsor (selecting the Joint sponsor option). I will file I-864A (also being the intending immigrant). Correct?
Q 2. In I-765, item11: i will mention yes for my previous OPT EAD. ?
Q 3. I am in the F2A category with my wife on GC, what will be my code for item 16, ©(9) or (A)(9)?
Q 4. I have never received an A-number for myself, however on the I-130 approval notice there is A-number, i assume that to be associated with the Sponsor (my wife) and cannot be used for the intending immigrant (myself). Please comment.

Thank you.

You will need to fill in I-864A only if you have your dependents (like children) filing AOS with you. If you are by yourself, you can fill in I-864 only as a joint sponsor, your wife will fill I864 as a sponsor. You have to submit a proof that you will be getting the income from the same source after you get your green card.

Q 2. In I-765, item11: i will mention yes for my previous OPT EAD. ? YES

Q 3. I am in the F2A category with my wife on GC, what will be my code for item 16, ©(9) or (A)(9)? ©(9)

If you have never received an A-number, then leave it blank. On I-130 approval, A-number for the petitioner and the beneficiary will be listed in there own boxes along with their names. If there is no A-number in the Beneficiary box, you don't have an A-number.

Thank you.

Thank you Arken for your responses.

Question to your response, So my wife files I864 as (1.a) petitioner and i also separately file I864 as (1.d) the only joint sponsor -- but the note on the form says "If you select Item 1.a.....1.f, you must include proof of ur USC, USNational or lawful perm resident status". I am H1b.

Since you'll be using your income together with your wife to meet affidavit requirements, you will have to submit proof that you're legally authorized to work in the U.S. ( Employment authorization card copy), as well pay stubs, W2s and tax returns. That will compensate for it.

My bad, i dont think you need to file 864 either as a joint sponsor. Your wife fills in i-864 where she will mention your income to prove the total household income is above the criteria.

No, you would not be your wife's joint sponsor for sponsorship of yourself. Yes, she checks off a. and you can provide your income to be combined with hers as the intending immigrant. You would not need to fill out any other form, but you would need to provide proof that your income will continue from the same source once you become a permanent resident. Check the I-864 instructions for more details.

Thanks for all the info, i am able to connect the dots now.

So my wife fills 864 and mentions my income as household.

So my mention is only going to be in part 6, item 17. --- if someone can confirm this to me that would be really great for me. thx in advance.

Your information and income will be filled out on Part 6, items 3-5 (Person 1). Your income (part 6 item 5) will add to your wife's income (part 6 item 2) to get the household income (part 6 item 15). Yes, part 6 item 17 will be checked and your name will be listed there.
