Hey

I don't have any idea how can I explain my situation,

My relationship with my wife starts in 2013 , we met each other on Facebook as many other couples. After many chats and corresponds , we discovered that we honestly fall in love with each other and we want to spend the rest of of our life together because we simply have many things in common. My wife decided to give me a first visa in January, she spent with me and my family ten days even though she wants to stay more days but she has to come back to her kids and job as well. My wife is 2 years than me.

We firstly applied for tourist visa in March 2014, the officer told me that you're denied because you may not come back to morocco as you don't have any properties.

After six months , we decided to apply for k1 visa . We prepared everything and send them our package. My interview was scheduled last March 19th 2015. I went to AP for 6 months. My wife tries to contact with the consulate to know what's going there since they didn't ask me for more evidence. She contacted with general inspectors , her doctor and a congressman.

After a long time , I got a called from the consulate saying that I should be in the consulate 10am, 31 August. I went there yesterday. I was waiting and waiting until the officer called on me . He didn't talk with me much , he only handed me a paper marked " section 221g which prohibits the issuance of a visa to anyone whose applications doesn't comply with the provisions of the immigration and nationality Act or regulations issued pursuant thereto. The following remarks apply in your case : Returned to USCIS for reconsideration "

I am asking you if there someone who has experienced this situation before , I want your help please. Is there any possibility to make them not to send it back to USCIS .

Well for starters you are saying your wife, but you applies for a K1 visa? Once you are married you are not eligible to apply for a K1. Could this possibly be the problem? If so you will need to file for a CR1 visa.

Timeline

Are you married or is she your fiance? Sounds to me like you applied for the wrong visa as you're married and the K1 is for people who are engaged and not yet married. If you're married you need to apply for the CR1 visa.

no, the men in Morocco refer to a woman as wife when they choose a partner/ probably not married

but to answer his question

Morocco usually does not approve financee visa / i went thru this / we knew each other nine months and i flew to morocco and spent a month with his family

in July 2009 applied for K1

but was denied / flew back and spent February and March there and married

best thing for you to do is marry in morrocco as i never heard a thing from USCIS when the original case was returned here

Since the marriage process is complex in MOrorro for an American ask her to send the important document such as birth certificates (she will have to have hers and her children) ahead of her visit to get them translated ahead of time and ready for all you have to do

Have your fiance's senator make an inquiry seeking a specific reason and ask for a second interview to keep the case at the embassy.

Very small chance but worth a try. If granted a second interview have your fiance at the premises and submit more evidence.

If the case has been returned then there is nothing you can do. USCIS will not review/reconsider but will let it expire and then you have to file again.

It's best to get married and file a CR1.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am so sorry my wife , I am used to call her my wife . We have not got married yet . We applied for k1 visa.

We had this same thing happen to us, there is no way to stop them from sending it back to uscis, and once they do, it will not be looked at again, they will let is expire. So your best thing for you to do is to marry in morocco and file a cr1. That is what we have done

If They returned it surely it will expire as it happened to us .So if already you petition was sent back to Uscis forget about it and ask your wife back to Morocco and get married refile CR-1 this time .

I totally agree with you on this point. My wife has called the senator in order to help us preventing them from sending back our petitioner to USCIS. He told her that he can't do anything as those officers are very educated and independent as well.

I am not going to care more about this visa. We have decided to apply for a spousal visa inshallah.

I only have one question for you please, how long time you have waited from k1 visa denied and start to apply for CR1visa ?

You waited only two months to apply for CR1 visa ? I guess that we will start our petitioner in January too, we can't wait anymore to be with each other.

How long time does it take for you to apply for CR1 visa ? Is it hard to do it in Morocco ?
