I filed for my wife and baby with green card. I got my citizenship last 2 weeks and turn in a copy for my citizenship for upgrade. They told me that i need to file another i130 for my daugher which i did. But now they were already schedule for interview using my green card status. Should i stop payment on the check i send to uscis for the i130 application? will the upgrade to immediate relative still continue since they were already schedule for interview?

So when you filed petition for my wife and baby, you filed one I130 for wife, and separate one for baby. Then you will not need to file another I-130 for your baby again after you became US citizen. If the interview date has been scheduled, then you have nothing to worry about it.

I have similar case as yours. When I filed petition for my wife and daughter based on F2A, I filed two I-130. Their priority date will become current by October Visa Bulletin (to be out around mid of Sep) and I have been scheduled for oath ceremony at mid of Sep. So weird and incident! Both will come at the same time. From my naturalization interview done to the oath ceremony, it will take 2 months.

Good luck and update me if convenient to you.

no i actually file one i130 for my wife and attached my daughter to my wife case at the national visa center and derivative beneficiary. i did not file for my daughter because she was not born at that the time i was filing for my spouse.

First your wife and baby shall go together for the interview. You may be lucky if the officer will give them both the visa stamp after your wife told the officer you're US citizen. If so, it'll save your money, time, and headache efforts.

If you're not in rush, you can just wait for submitting I130 for your baby after the interview date.
