conditional GC, divorce and travel outside of USA

I am conditional GC holder, just got divorced, but planning on sending my I-751 waiver next year.I am planning on visiting my country in about 2-3 months.Am I going to have any problems. Re-entering USA? I didnt inform USCIS about my divorce, but I dont know what my ex did.Thank you all for taking time to read

From what I've read on here, you can (and should) apply for ROC as soon as your divorce is finalized. Once you have the divorce decree in hand, you should remove conditions on your own.

I know that, but I was wondering if I can still travel without applying for ROC, will there be a problem with returning at POE

The reason why it is recommended to apply for ROC as soon as divorce is final is because 1) as you are filing by yourself under waiver, you don't have to wait until the 90 days before expiration to file, and the earlier the better (waiting is not going to give you more evidence of bona fide marriage; the past evidence is going to get lost over time), and 2) because, technically, USCIS can revoke your conditional green card as you are no longer married. However, I have never heard of USCIS doing this, so in practice you would probably be okay to wait until before the 2 year mark to file ROC.

As long as your green card has not been revoked, they should let you in, regardless of your marital status.

But why not file for ROC? Filing and travel do not conflict; you just have to remember to be in the US for the biometrics.

This is what I was thinking, too. And why I mentioned the filing of ROC immediately after divorce instead of waiting until next year.

No one can ever guarantee you re-entry into the US. Even with a green card, you can be denied entry if CBP determines it to be the proper course of action. While I think you're running a slightly bigger risk by not filing ROC now and waiting, you'll most likely be fine (but was hoping someone with more direct experience would chime in).

I'm confused, your previous post said you were the petitioner of a guy who used you to get a green card and has no evidence for the ROC.

Are you the U.S. Citizen or the foreign beneficiary?

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
