Good Afternoon Everyone,

Am new to this whole process. My Fiancé leaves her in the USA but he was no paper. I just want to know what kind of visa I have to do and if is going to cause problems. He only has 1 year in this country. We want to marry in a few months but we doing the civil marriage first than the big celebration in the Dominican Republic with our family. Can someone please help me. Thank you so much.

Let me see if I have this straight:

  • You are both currently in the US.
  • Your fiancé does not have a green card.

In order to clarify just what your situation is and what can be done next, I have these two questions:

  • Are you a US Citizen?
  • Did your fiancé enter with inspection (i.e. entered legally and overstayed)

February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

January 28, 2014: Production of new Green Card ordered

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Concurrently file the I-130 and I-485 once the civil wedding takes place. The sooner you marry and start the process the better because your fiancé is deportable until then. If he were to be detained and deported, he would be banned from re-entering for 10 years.

In your specific circumstance, it will not be possible to travel to the Dominican Republic to hold the big celebration until the AOS process is complete and the green card in hand. Leaving before the AOS process is complete will trigger the ban.

And congratulations on your wedding! One piece of advice, you can get a lot of good information on this forum as you go through the process, and one thing that will help people give you advice is if you keep your timeline up to date, including the country your spouse is from, date of marriage, date of filing with USCIS, etc.

Ok thank you so much. I have the wedding certificate with me. They gave it to me the same day.

You can file as soon as you have a photocopy of the marriage certificate and your relationship evidence is complied.

Hi Everyone,

My husband and I married almost 2 months ago. Today we deposit the application for his papers. Thank God ?. I was wondering how long the process will take. The person that prepared the application said it will take less than a year. I just want to know from how long it will take with your experience. Thank you so much for your time and help.
