So I got a response from Senator Warren's office. My case had been sent back to TSC after being sent to NVC and they were absolutely no help. There response from USCIS is that my case was approved 5/28/2015 and it was sent to NVC 6/8/15.

I then called NVC after getting home from work and they told me the same thing that my case was not received yet. I actually broke into tears. I was trying so hard to hold it in because I didn't want to sound stupid. I asked if anyone could help me because I have tried everything. They finally got a supervisor on the phone for me. The supervisor has to contact TSC and also a few other places and also check their mail room. They are going to call me with answers. I honestly feel so powerless.

Instead of waiting, you can go ahead and send a letter to the USCIS withdrawing your I-129F petition. You can then get married and file for a spousal visa, if you wish. However, you need to go over your I-129F petition to figure out why it would have been sent back to the USCIS before going forward with another petition to avoid having delays/denial of that one as well.

This is a very bad advice. Why would he withdraw his petition when he is this close to getting his visa? All that needs to be done is ask USCIS to find the petition (which after the OP's new post seems to be happening). Please don't give advise like these as they can make the whole situation way worse.

I am sorry this is happening to you. I've heard of some people's cases getting lost on their way. You can use the search function and maybe find out how they dealt with the situation. I'm really really hoping that they will find your case soon and have it on it's way!

They asked if they should go ahead and get married and start over with a spousal visa because they did not want to wait 6 months to hear anything about their petition after being sent back to the USCIS. I never offered my opinion or advice on what I thought they should do. I answered their questions about what they could do. Make the situation worse? You mean for wait time? If you meant some other way, then please do share. Yeah, they would still have to wait, which I assumed they knew before even asking, and I added in the fact that they needed to know why their petition was returned in the first place before deciding to venture into fling another petition(which was posted before all the other info came out and was clarified that the USCIS or the DoS lost their petition somewhere).

It is terrible that things like this happen, and I hope they do find their petition soon.

I had the same situation on where my files got lost on the way to NVC and no activity at all for 5 months after it was approved. They found my files at a so called " record facility" after dozen emails and few dozen calls and with the help of the local governor.I hope they find your files just like mine.

Thank you. I am hoping the supervisor at NVC I talked to finds something out. He said he has tried for other people and he still hasn't heard anything after 3 weeks. I feel like my senator was absolutely no help. They have not looked into the issue as I asked and I just sent an email that they did not respond to. I am really hoping for some good news from the supervisor from NVC

So I got a strange notification from USCIS notifying me my I-129F was approved 9/10/15. I called NVC and told them my situation and asked what it means because USCIS was closed. It seems like calling the supervisor a few weeks ago really helped. It possibly got my petition the push it needed. I will call USCIS on Monday but I'm hoping it means I will have no more bumps in the road. I'm crossing my fingers. It appears my case got lost in limbo and sent back to TSC and then they re-approved it. I have no idea. I'm hoping this is good news!

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
