What law requires a consulate to except evidence that is already in the packet but not presented at interview

Hi

My husbands birth certificate and copies were all sent out with the i130 petition. Now I don't have an original or copy. I heard that there was a law that requires the approving party, NVC or consulate, to approve of a petition or case even if some evidence as not presented as long as it is provided in the file they have.

Is there really such a law? Or do I have to find a way out of this birth certificate mess? Any suggestions?

The reason that it is recommended to bring a copy of everything submitted is so that if something gets lost or misplaced the information is available to to consular officer.

It's always good to have at least one official copy of a birth certificate for reasons that do not involve US immigration. You may or may not get the contents of your file back, that is why unless specifically requested a person should submit copies and have originals at the interview for inspection.

I am worried because a birth certificate is needed for the IV package and for the interview; and the beneficiary doesn't have one anymore. It was sent out with the i130 petition.

If an official birth certificate or copy is required at the interview then (if approved) the visa would not be issued until the birth certificate or copy was submitted.

So it would be a good idea for the beneficiary to obtain at least one additional official copy.
