Take Care of My Mother Abroad With An I-551

Thanks in advance for your responses. This is the situation: I am currently residing in the U.S.A. as a Permanent Resident. I need to go back to Nicaragua and take care of my mother, she is very ill and need constant care. I have payed for care and up to this point, there is person taking care of her. But I feel that I should take care of her up until she goes to a better life.

My question: Can a I-131 be able to get me to spend 2 years in Nicaragua without the necessity to come back to the U.S.A. during that period? I have read that I need to at least come every six months to let know the U.S.A. government that I intend to reside in the U.S.A.

You can apply for a re-entry permit using an I-131. This will allow you to spend up to two years outside the US without the presumption that you have abandoned your residency, but you must ensure that the US remains your permanent domicile.

You should continue to file federal income tax returns, maintain a US residence (paying rent, property taxes, etc.), maintain bank accounts, and so on. You may be asked to show this proof of non-abandonment when you finally return to the US.
