Child Authorisation to leave Australia.

Hoping someone can shed some much needed light on this; Would you still need authorisation from a parent who does NOT live in Australia to remove your child out of Australia on the k1 visa?

My daughter was born in the U.K. and 5 years ago we returned to Australia, we have had no contact with the father for those past 5 years, no financial support nor were we ever married. Recently she was granted a new Australian Passport without her fathers signature as immigration was unable to locate him in the U.K. Hence getting permission from him for my daughter to leave Australia would be impossible.

Some people have said that it shouldn't be an issue as he doesn't reside in the same country, im not so sure.

Would be very grateful for any help or advice.

I have similar situation but with 2 kids , their biological father knows nothing about them neither know how they look like, he went out of their lives 12 years ago when my little daughter was only 3 months and my son 2 years &half , no financial support at all . Now my US husband applied for all of us , but some members told me that I should ask a lawyer whether I can be able to take them out of the country or not, and I did , the lawyer asked me whether he banned their moving from the country or not, I said no . he then said as long as your ex did not do anything before the authorities to ban the kids from leaving the country with me, then there is nothing to worry about. I think your chance is much better than mine, as your ex is not in the same country with you.

thanks for the reply. I think in your case where the father resides in the same country, you will be asked to show that you have tried to make some kind of contact with him in regards to getting his permission for the removal of the children, even if you don't know his exact location. I know at the interview you will be required to produce this. I'm thinking of getting an affidavit just so I have some kind of legal document, maybe this is something worth considering for yourself.

My fiancée and I are in a similar position, her oldest daughter's father does not live in the Philippines and doesn't care for her and her youngest daughter's father lives on the other side of the Philippines and the same situation, wants nothing to do with her and no financial support for her so do we need to provide any paperwork at all for the K1 visa to get her daughters to the US? Any help is appreciated.

Are these dads on the birth certs anyone?...I dont support the idea of kids not knowing

and bonding with either parent, as long as they are not abusive, although they give

no emotional or financial support they still have some rights & its only fair to kids

to know where they come from biologically, however in this case these ladies I think

should just say I don't know who the father is....this happens!... maybe embarrassing but

if it can get things moving why not.

I agree with you that a child does have a right to know both parents but that really isn't the issue here. I cant speak for the other ladies as everyone has their own story as to why a parent is absent but in my case her father made his own choice not to have contact for what ever his reasons may be.
