Some countries embassy don't accpet joint sponsor for k1 .u should check embassy website.if u income fill full poverty guidelines u don't need sponsor.u can ask them to write a latter of stating about ur income and sign and Stemp it.it will workout for u,

OP is filing I485, which is not done at an embassy. A joint sponsor will be accepted for this.

Seems like it is a lot of trouble proving this to USCIS. Would I get in trouble with USCIS if I try to send a revised i864 with 0 income on it and a letter stating that I just started recently to work for Uber/Lyft and cannot prove income as of now. My mother is my co-sponsor and she has great income.

I began working at Lyft in March and dor Uber in mid June.

I submitted AoS for k1 visa with two i864, one for me and one for joint sponsor. On mine I indicated that I make $2000 per month with Uber/Lyft. I also attached a letter stating that I have no way of proving my income therefore I have a co-sponsor. These guys ignored my letter and sent me RFE that I have to get a letter from employer and paycheck stubs for 6 months. I have no way of providing that.

Can you plsease suggest what should I do next? Can I sent them a new i864, indicating that I have no icome instead?

Call uber. any company has records of their employees. they will have some paperwork for sure.

Write them a letter again, stating your circumstance. Re-tell them that you have a co-sponsor. Maybe they just want to know how you get your money. Still try to find a way to prove your income. How do you get paid from Uber/Lyft? Check you bank transactions, I'm assuming that there are records of monthly deposits to your account. Ask a letter from your employer that you are working for them even if there's no annual salary statement.

list I provided, you can't send them what you do not have. Why risk starting all over again with another $1070 fee if they deny.

Thank you for your help. I forgot to check "self employed" on my i-864. I thought these guys can read, I asked them to use my joint sponsor for income purpose, my mother makes way over required threshhold... But they ignored it and just want to know where I get my money.

I suppose I would have to send them in an ammended i-864 for myself, where I will check "Self Employed". Correct?

Dear all, sorry to bump this topic. After sending RFE response, our cases for I-131 and I-765 are showing now "Case approved" and letters with confirmation were sent. However, I-485 still shows "RFE Received, our NBC will resume working on your case."

Does this mean that I-485 was also approved, but was not updated online (as many people reported before)?

No, it doesn't mean the I-485 was approved, as indicated in the update says they will resume working on your case. It will take several months longer, some have to wait a year.

Thank you for your reply. I was under impression that I-131 and i-765 were very very related to i-485 case and if there were issues with i-485, the first two would not be processed. Thank you for your input.

They are very related in that if the I-485 is denied so is the I-131 and the I-765 but unfortunately you can be denied I-485 all the way up until

during/after the interview. You can also receive an interview waiver letter and then get an interview appointment anyway and still get another RFE

at any time.

So how did you respond to RFE? I am getting a RFE as well and I have a good feeling it's i864 related...

I produced as much evidence as I have. I printed out all UBER and LYFT deposit statements, made a copy of bank deposits sorted for sums above $300, and made a letter of employment for myself that I am an independent contractor driver. I also included past tax return.

I also included amended i-864, where I changed from employee to Self-employed (my mistake)

My professor for immigration law, as well as everyone on this forum, stated that USCIS wants what they requested, and nothing else. So make sure you can provide as close as possible what they request. They asked me for 6 months of paystubs, but I could provide only 5. Hopefully this will cut it.

I just got a notice that EAD and AP card was produced and mailed. This is very important to us because we will travel very soon. Hopefully they approve RFE as well. Thank you for your input!
