Notice of Intent to Deny- please help!

Could somebody please help. I am adjusting status from K1. We submitted our AOS package October 2014, medical had not yet expired, medical had been completed in Nov 2013. We received a letter in Jan 2015 stating they were working 6mths behind and suggested we may be waived for an interview. Today (Aug 2015) i have received a notice from the Raleigh-Durham Field Office, NC (I live in FL) of their intent to deny my application due to "overseas medical submitted was expired prior to filing I-485. It states i must submit a completed I-693 Report of Medical examination and vaccination record .

It also states i need to submit a completed and signed form G-325A.

Could somebody please clarify what this is about and what i should do. My understanding was that if your medical was under 1yr old at time of submitting AOS from a K1 that you did not need to resubmit a new medical. Who should i call to speak to and what should i say? I'm sorry im so stressed out by this. Thank you in advance for any help

There's been a lot of threads about this lately. You need to re do the medical unfortunately.

You can try to fight it but it is easier to just redo the medical. Technically yes, your medical is valid if it was less then a year old when AOS was submitted.

Save time, get a new medical done.

Get your vaccination records together and send the I693 and all vaccination records back to USCIS with the original RFE (make a copy before you send).

As long as that's all they need, you shouldn't have any issues with approval.

Sounds like they are requesting a "completed I-693 Report of Medical examination and vaccination record."

That includes a full medical and x-ray as I understand it. They have been denying for not submitting what is asked for so I would not

play a guessing game with this and do the full medical, blood and x-ray too.

Even though K1's have been exempt from doing new medicals, adjudicators have RFE'ed for it and it sucks.

You need to redo full medical exam. You are in no position to reason with uscis, especially they already sent intent to deny letter.

Most civil surgeons will require a full medical unfortunately. When my wife filed her AOS, her vaccination record was incomplete, and we found it less hassle just to redo the whole thing.

thanks everyone, this is so frustrating after waiting so long, but just another hurdle to jump through. I was able to make an appointment for medical on this coming Tues.

When hubby did his AOS a few years ago we received an RFE for the same thing. His green card was approved two weeks later. This may be good news for you.

Hi OP, I received the same. Thought about fighting but as others said, it is not worth so I just re-did my exam. They didn't do the x-ray like in Sydney. They did a TB test in my arm and I had to come back a couple of days later for them to check if any 'reaction'... I'm in Iowa and it cost $250. It is a joke as the doctor just checked my blood pressure, heart, ears and nose. That was all! And they don't even give the result straght way. I had to go back after a week to pick up the envelope.

that sounds similar to what they said to us- no x-ray unless i react to the skin test. We were so lucky to find somewhere that will do it for $95 plus any vaccines i need which i'm hoping wont be any!

Call around and compare prices, they can vary a lot, it may be worth it to drive a bit longer to get it done with someone who

does not over charge.

It sounds like you need the whole I-693. It should tell you when it is due together with the other requested evidence. Typically you don't need chest x-ray unless your TB Test is positive, but that is again up to your CS. As for the Notice of Intention to Deny, just make sure you send everything back BEFORE the due date per your letter. I received a RFE for mine so it's one of several things they do to get evidence. The other case I saw that received a Notice of Intention to Deny happened to come from an office in NC, so maybe just a different way they handle their cases.

I definitely agree with the above! Call around. The prices I got range from $150 to $450. Make sure you get your results IN A SEALED ENVELOPE and do not open it. Just send it like that back to the address together with a copy of your notice (and other requested evidence).

Thank you all so much for your help with this. I was able to find a Civil Surgeon who completed my medical for $95. I did not need anymore vaccinations as they accepted my records from last medical. I passed the skin test so no need for an x-ray! I now have my results and need to send them back however the letter i received doesn't state where to send it back to. Do i mail to the address on the top right hand corner of the letter? and if so, do i address it to the Officer who sent the letter or just send it to the office? The address is not a PO Box so i'm hesitant to send it unless i know for sure, i did try to call USCIS and the person on the phone said it was at my discretion where i send it...
