Hello all,

My husband and I got married in June and shortly after I lost my job so we have a sponsor but she only has taxes for 2014 and 2013 not 2012 is this okay? If not what do we need to do? Husband came from England on a K-1 just FYI :)

If she was required to file but didn't then she will need to file a late tax return and attach an IRS-generated tax return transcript before submitting the I-864. Here's the excerpt from the I-864 instructions:

"If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it. Residence outside of the United States does not exempt U.S. citizens or lawful permanent residents from filing a U.S. Federal income tax return."

Timeline

Well, on the I-864 form, you're required to list the income from the past 3 years and that includes 2012.

If she doesn't have a copy herself, she can request an IRS tax transcript from this website: http://www.irs.gov/Individuals/Get-Transcript

You're not required to submit a copy of the last three years transcripts (only the current year), but you still need to put down the amount on the I-864.
