I was denied a visa at my interview in Ghana on the 07/28/15. The consular keep talking about how she feel our marriage pics and all other pics were photo taking.she said she dont understand why when my wife was here for the marriage none of her family came with her. She finally gave me 221(g) and she would not even allow me show her material facts that I had with me. Our marriage is bonofide and we have all that fact to prove it. But now that she is sending our file back to uscis what do we do? Pls we need descending minds advice as to what to do now to over come this heart breaking decision. My wife has been here 2 times and will be here next month again.

Wow, that's rough. It must be so frustrating to hear someone say that you're not in a real marriage when you love each other and know that you are.

I don't know what the process is once your case is sent back to USCIS but hopefully, you'll get a chance to add more bona fida proof. I just wanted to say that I hope it works out for you and wish you good luck.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

They will return the case back to USCIS and then the petitioner will receive a NOIR/NOID letter requesting evidence of a bona fide relationship.

She has to submit the evidence and then it will go back to Accra for another interview. This process can take 6 + months.

Follow your case on ceac and USCIS site for updates ( may not be updated) on where your case is and get the diplomatic pouch number per

senator.

Right now your wife can do this : Contact her senator and speak to the immigration aide to request another interview and to accept your evidence.

Get several affidavits from her family attesting to your genuine relationship and stating reasons why they did not attend the wedding and that they are in full support of your marriage and that (perhaps) you are all planning a celebration/reception after you arrived in the USA.

Long shot but possible. If the request is rejected the case goes back to USCIS. Only USCIS can deny the petition, the CO can only refuse to

issue the visa and return it with recommendation to revoke. Your petition is not denied, it is still alive.

Happens all the time in Ghana, lots of others are in your shoes.

Until you get rid of the two ladies KM and Alma Gurski. At that embassy it's not going to get better. They have an agenda and they don't care about the evidence you bring thay won't even look at it. All they say is what thay feel your relationship and marriage is not real. Call your congressman and Senators and Inspector General and make a complaint about these women and what they're doing. Somethings got to be done

Now my wife congressman has contacted the embassy and they said their findings was that they feel the marriage is not bona fide and that my wife will have to go for an interview in the US to rebut the case with evidence wen the case is sent back. Funny!!!. Now my wife has contacted the senator and she is also to ask them to grant us another interview and accept our evidence, dont know how that can work out. Sad we are going through this after all our documents are being satisfied by the appropriate departments and now one person is making life a hell for us.

I highly doubt that USCIS will call her for an interview, more rubbish from them. She has to respond to the NOID/NOIR letter and submit evidence.

If they really wanted to the CO could call and interview her on the phone, that is what they did to me and he was approved.

I see you recently joined. I must assume you not learn about sideloading during NVC Doc Intake, about 8 months ago. Sorry. High-fraud IV Units are trained to seek the fraud based on contents (or lack thereof) of the casefile, prior to interview day. Interview day at a high-fraud consulate/IV Unit is NOT the time to hand over evidence.

But it's too late for you two to fix this via sideloading.

For now, the casefile will return to USCIS via NVC and at some point, if the USCIS office decides that there's a possibility to re-evaluate stuff on you two, the petitioner will receive notices about it. Pay attention to the notices, give over what is asked for. How long to wait? figure 4 to 13 months. Why so long? That casefile is not automatically sent off next day from the IV Unit, and there's routing and queueing within NVC and USCIS.

My case was completed on August 5th yesterday. Is it too late for me to sideload with evidence at the NVC as you advice?

Yes it is. I wouldn't send anything to NVC now as your casefile will be sent to the embassy soon and whatever you send may not "meet" up with the original package.

Sometimes I just feel like saying fucknit and let them keep they visa so my wife can always visit and go. I am too husy for this people to be playing around my life. Now they have just messed our plans up and we just dont know what is what again because this people said dont call, just wait for a letter. Deliberately bullying people througj documentation. We have everything facts and every evidence to show but this people wount make sense with that. They wouldn't tell you what to bring on your interview and I was our first time and we didn't even know we have to carry the whole world evidence to them. I feel like letting go of his nonsense because someone is deliberately making life hell for us now.

Denials are not trivial things. We had one on our first K1 application and it is horrid that they feel they have the right to question your intent. Our second K1 went through much faster than normal at that time and we were together after a year delay. The only thing you can really do is play their games. With persistence you will win, don't let them break you down.


This will not be over quickly. You will not enjoy this.

Hang in there. I understand your frustration. Just wait for the NOID/NOIR letter, submit the rebuttal with the evidence and you will be approved

soon. You are too close to turn back now and having a marriage based on a few visits a year is not good. Perhaps she can move there if you are

both really tired of dealing with this but I would encourage you to endure these last few months, this too shall pass ;)

It took us 5 years. Our first K1 was denied after 16 months in AP and we were also successful with the second K1.

You just have to make up your mind to see this through and relax a little.
