Independent Contractor and I-864 clarification and Police Clearance Certificate

Hi everyone,

Need some clarification. I've read the forum, but want to make sure on this one. My NOA2 was approved on July 29th and I'm still waiting to get my case number and Invoice ID number.

My wife is in India and is it possible for her to request the PCC before having a NVC number?

Im trying to gather everything I can to save time...

Also, Im an independent contractor and working for a company for 3.5 years. Thus, I dont have any W2's, but I do have my past 3 years tax transcript from the IRS and I am above the poverty level (125%).

Can I fill out the I-864ez or since I'm an independent contractor I should fill out I-864?

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You can use the NOA2 as a proof to apply for PCC. Thats what I did. So no worries, do start the process. Have you package ready to send.

Unless your income is not fully from W2 you cant fill I864ez. So fill I-864.

When you send the package, include all you schedules and tax transcripts. Whatever the documents you have and used to file the tax.

Thats how I able to process my application without any issues.

Hey! I too am an Indian National. Your wife will have to get her PCC from the regional PSK(Passport Seva Kendra).

Also one more important thing. Your wife will NOT be issued a PCC unless she got your name added in her passport. It will appear on her biographic data page. So, if she has not done that already, get her to do the passport thing first, only then will they issue her a PCC.

I know someone who did not do this despite of a 100 warnings from my side, and she did have to get her passport changed now. Her AOS and IV fees both have been paid but cannot send the packages in since there are no available appointments at the Ahmedabad PSK till 28th of August. So, just a word of caution, make sure all of these things are done beforehand.

30-Dec-2014: Married

19-Jan-2015: I-130 Sent

21-Jan-2015: NOA

16-Jul-2015: NOA 2 (No RFE's! Yayy)

15-Jul-2015: Case sent to NVC

22-Jul-2015: Case received by NVC

5-Aug-2015: Case # and IIN assigned

6-Aug-2015: Filled and submitted DS-261

7-Aug-2015: AOS fee invoiced and paid(Status: In Process)

10-Aug-2015: AOS fees changed to PAID

10-Aug-2015: AOS and IV packages sent

12-Aug-2015: AOS and IV packages received(SCAN DATE)

13-Aug-2015: DS-261 reviewed over the phone

14-Aug-2015: IV fee invoice received

15-Aug-2015: IV fee paid(Status: In Process)

19-Aug-2015: IV fee status changed to PAID

19-Aug-2015: DS-260 completed

21st-Sept-2015: Put on supervisor review :(

03-Nov-2015: Case Complete!!

14-Dec-2015: Interview Day!!!

Hi, thank you for your advice! Yes, my wife has added my name to her passport and now just waiting to file out the ds260 and moving forward. Best of luck moving forward!!
