Hello everyone,

I was wondering if AAO send you directly a notification letter in case they sustained your appeal as they would in case they denied it?

I have received my case update that say as follow:

Application Type: I290B, NOTICE OF APPEAL TO THE COMMISSIONER

"Your Case Status: Initial Review

On July 31, 2015, the Administrative Appeals Office (AAO) transferred your Form I290B, NOTICE OF APPEAL TO THE COMMISSIONER, Receipt Number MSC xxxxxx ,to the USCIS office that made the original decision on your case. That office will mail you our decision or send you a request if it needs something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

My next question is that after reading this update, can one tell if my case was remanded to USCIS so they can give another look to my case and render a new decision or the case has been approved by AAO?

I Will appreciate any help.

From what I read it was approved by the AAO and sent back to the office that made the original decision. That office will re look at the the info and send you the new decision. I would read what you sent and they reaffirmed thing and sent it back to the the agency that made the decision to re look at things. It would help if you would fill out your timeline. It helps those that want to help to have more info.

Good Luck.

I have a similar case. I am 245(I) life act applicant. My case is also at AAO office MSC centre. I am in my 6th month havent received anything as yet. So hoping for the best cause my attorney is confident the field office erred in there decision regarding grandfathering and we did provide the brief and all the supporting documents. How long did it take for you after filing the appeal if you can share either here or at mikeptl72@gmail.com.

Thanks for prompt reply. My LIFE ACT was denied due to grandafathering . The only resason Field Office denied is saying that the original company which filed my labor they made a loss in the year of filing because of which my i140 and i485 was denied. But to the best of my knowledge its got nothing to do with being grandfathered thru labor certification. So we do have a new i140 approved and my original labor was also approved filed before 2001. So the field office boottrapped i140 immigrant petiton rule to labor grandfathering which is a bs. But god willing ill see the green card soon been here for last 18 years. Share your thoughts or u can email me too mikeptl72@gmail.com. So also after aao APPROVAL U GOT UR GREEN CARD STARIGHT AWAY OR AHD TO WAIT TO GET CURRENT

Could someone tell me after AAO transferred the case to the original office, how long did it take them to send you the notice? My son is turning 21 soon, if they don't get the decision to us by his birthday, everything we tried to do for the past years would mean nothing. Thank you so much.

My case was approved 7 months later even though the AAO processing time frame said 6 months or less.Hang there you should be getting a decision soon and I wish you good luck in mean time.

@Blocus I am in he same situation as you were. I just received the same LUD :

"On September 12, 2016, the Administrative Appeals Office (AAO) transferred your Form I-290B, Notice of Appeal to the Commissioner, Receipt Number W*********2, to the USCIS office that made the original decision on your case. That office will mail you our decision or send you a request if it needs something from you"

Could you share with me the final approval update you received.

Thanks,

Folks

Any update on what that status meant?

I got similar status today for my I 140 - Any idea what this could mean? Thanks!!!

On December 14, 2017, the Administrative Appeals Office (AAO) transferred your Form I-140, Immigrant Petition for Alien Worker , Receipt Number -------, to the USCIS office that made the original decision on your case. That office will mail you our decision or send you a request if it needs something from you.
