Affidavit of Support-Void after marriage?

Hello! Even though the affidavit of support for the K-1 Visa is apparently not enforceable by law, does any implication of responsibilty become void after the official marriage? Thanks for your help!

To apply to adjust status (AOS) aka apply for green card aka the thing you're not eligible for until you're married but must be applied for in 90 days, you sign another affidavit of support which is thr one that is legally enforceable for 10 years or until the foreign national leaves the country or becomes a citizen, even in the case of divorce. The one for K1 is their way to make sure that you'll be able to adjust status. They don't want to let you come here to get denied for AOS.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Sorry, there is no 90 day requirement in which it's mandated by law to file the Adjustment of Status. That's just wrong. In fact, there is no time limit on it.

Sorry, there is no 90 day requirement in which it's mandated by law to file the Adjustment of Status. That's just wrong. In fact, there is no time limit on it.

Sorry. ..maybe I'm confused. I thought that to maintain legal status, AOS was necessary? And that K1 status runs oit after 90 days? Is it only the marriage that needs to occur? And if so, what is the legal status of the alien after those 90 days?

one can have a gap in legal presence if :

1. marry within 90 days

2. file the Adjustment of status anytime , up to 2 years after marriage date

and

when the first receipt notice comes in, a new period of authorized stay commences

and

any overstay between the gap is automagically forgiven when the greencard arrives.

It's a benefit, being married to a USA citizen and filing for Adjustment of status, adjusting from a K-1 visa.

Hang in there, you'll get it soon, I note (by yer posts) that yer coming along...

I don't understand your question. If it's not legally binding, then it's not legally binding, before marriage, after marriage, or any other time.

The I-134 is not legally binding. It does not matter if before or after marriage. The government cannot sue the sponsor based on the I-134. When you need to file for AOS, then you must provide the legally binding I-864. Those obligations, and how long they last are listed on the form before the signature in Part 8.

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.

The I-134 is not legally binding. It does not matter if before or after marriage. The government cannot sue the sponsor based on the I-134. Ah ok. I did think that it was required to AOS---which it seems like it is unless you want to run the risk of being here out of status/accruing unlawful presence?

Either way, point to the OP: no, THAT piece of paper is not legally binding, but the one that you more than likely will need to sign (if you are interested in your spouse having a green card and being here legally) IS. The I-134 is almost like a pre-screening to make sure that you will be financially eligible to AOS, when the support is binding.

Thanks. It still feels like never. I'm really trying to not think about my timeline or CSC or the fact that people who applied months after me have already been married for a month or more :(

I'm mostly just hoping that we're done with this before the new year, and trying to not think about this wasted 6 months of our lives.

Also though--question. If you don't AOS for 2 years....what happens if the foreign national is arrested or pulled over or generally has a run-in with authority in those two years?

There have been some cases of those here on a K-1 that had not yet applied for AOS and were detained by ICE. I have seen two cases getting detained from riding a bus. They sometimes do sweeps on the buses, and they were found that way. Most states won't allow someone that is out of status to get a drivers license, so not too many would be out driving to get pulled over. Usually people go the entire time they are out of status without ever having a run in with ICE.

When detained, the IJ will most likely order them to file for AOS immediately, since they are eligible to do so. Have not seen a case of anyone here on a K-1 being detained and then actually deported. They may exist, but I have just never heard of one.

I think the 90 days you are referring to is the need to get married within 90 days for fiance visa. :)
