Hi there I have a quick question. My husband is going to his interview on August 24. We got his I- 601a waiver approved, have filed I-130 approved, and I-485. I'm just nervous about 2 things and I don't know who to ask. First thing he tried to cross once, was caught the same day took his fingerprints and got let go as a minor 15 yrs old. The immigration police told him to say he was an adult to let him go the same day of he would need to stay until an adult family member picks him up. 2-3 days later he crossed again and was successful and has been here in the U.S. ever since. 2nd thing is he has criminal background, 2 failure to identify, one has been dismissed and the other was a class B I believe and was time served since he was in jail for about 1-2 days. The 3rd charge was MIP (minor in possesion of alcohol) this case was also dismissed. Would go you have an idea what are his chances?

Usual problems arise when there is something not mentioned in the 601a application that comes to light.

Why are you filing an I-485? If your husband entered without inspection, then he would have no status to adjust from.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I am not sure, that's exactly what I said.. My lawyer did this (years in the "game").Something about qualifying for it because his my spouse and i601a was pending approval and now approved. That is why he qualified for interview in Juarez.

I 485 is nothing to do with the route you chose.

Check carefully before he leave the US many get stuck outside due to

other issues found, or things not disclosed, Did your atty get his foia

so he could at least front load with a letter showing his age now and

then that he was a minor (the fingerprint & name can prove age)

Please sit with the atty ang go over the case properly, there have been

approved 601A who get to consulate & realize that they will need a

regular I601, they have to wait outside or they have basn for misrep

or other reason.

The fact that its approved with all things disclosed, may just be ok but just

know before you go

You cannot adjust his status. The point of the I-601a waiver was so that he could be allowed to leave the USA to interview in Mexico without incurring a ban. The I-485 was a huge waste of money and was not needed in your case.

I-485 means: I-485, Application to Register Permanent Residence or Adjust Status

He has no status.
