Hey guys, i have a question. My fiance had a part time job last year and didnt make the poverty line. This year she makes more than the 125% that is needed. We want to start the K1 proces asap. But does that mean she has to wait till april next year to show her tax returns before we can start filing? She has a traveling position and i wonder if a letter from her employer would be enough evidence to already start the proces right now?

We don't wanna waste any time but we do wanna make the smartest decision. Is there any way to start the proces now or do we really have to wait to show a tax return?

Thank you.

If she CURRENTLY makes more than the needed amount then you can go ahead and go. She'll have pay stubs and a letter from her employer showing that she CURRENTLY makes what is needed. No need to wait if you don't want too.

Thanks for your reply! Thats great news! She has a traveling job which means she works on and off for 13 weeks all over the states making good money. Would a traveling position be an issue?

I don't think it'll be an issue, a jobs a job, as long as she can verify employment and they give an estimated salary of <blank> a year by her employers she should be fine!

My visa was approved today! Am glad. And to answer your question, please start the process. My fiance filed on the 11th of July 2014 and the approved didn't come until April 1st 2015.He didn't also send his tax forms at all. I however went with taxes filed for the last 3 yrs. There was a man there who came with tax clearance for 1 yr(2014). His approval was put on hold (not denied)and he was told to tell the petitioner to provide that of 2013 n 2012.

What did your fiance show as proof of income? And why did you need to show tax returns? I thought the income of the one being sponsored is irrelevant.

It depends on the consulate. Some want all three years, some only want the most recent year. Example Montreals is: . Proof of Financial Support (Form I-134) and photocopy of supporting documents (IRS transcript or photocopy of the most recent Federal income tax return, bank statements, employment pay slips, etc.)

When he filed, he got a letter from his job verifying his employment. That was all he used to file the petition. In April when we got our NOA2(The approval) I insisted on getting the tax certificate n transcript for the interview. And it was a smooth interview

Also, is she able to request a tax transcript from the IRS for this year or is that not possible?

Yes, the IRS will send them to you if you request.

So if she contacts the IRS they can send her a transcript which shows what she made so far this year? (January - end july?) What did you mean with the empty quote? The post above this one.

No. A tax transcript only is a transcript of your return, which you file between January 1 and April 15 of the following year. Many pay stubs, however, show how much the employee has made that calendar year. That should help (along with a letter of employment and additional pay stubs that can tie to the letter).

IOW, she just has to provide a handful of pay stubs and a letter from her employer stating she makes $xx,xxx/year.

Removing Conditions Timeline

Aug. 21, '17: NOA1

October 23, '18: NOA2- approval

October 30, 18: 10-year GC received
