My husband has been having an online affair, and is planning to bring her here on a tourist visa, then apply for a change of status. At what point in this process should I report them? She has already applied for her passport, but not the visa yet.

Well, he is hoping the polygamist can get plural marriages passed. But, besides that, the original plan was to change status from tourist to immigrant with asylum or persecution status. Her partner beat and raped her, and she just recently got away from him. Still, the tourist visa plans are on the table.

I don't know what you mean by own merits. Her intent is to stay in th US after she gets here.

She has to prove her case to get the visitors visa. Once she has obtained it, if she applies for asylum intent isn't an issue, however the b2 is cancelled. She would have temporary protected status until her case has been adjudicated. If denied she would be placed in removal proceedings It is a highly complicated issue.

She wasn't going to apply for asylum until she gets here & that's even up in the air. The asylum is not really an issue now that she has moved from samar to manila. The guy who was abusing her lives 12 hours away from her now

Personally I would divorce and move on with your life.

I know most women wouldnt put up with this BS, but he has told me maybe she can get settled in manila (she DOES have 4 children in samar), and not want to leave her kids. My life was ####### before i metmy husband and ive pretty much had free rein since. Weve beenmarried 27 years, and i waited until i was 27 before i found someone i could stay with. I dont want to be alone. I just have to find a way to deal with this situation.

So...do i act like everything is okay by me, then report her and get her permanently banned from the US, or do i tell them that they will have to do things by the book - honestly and truthfully-no matter how many years it takes? He tells me that he doesnt want to lose me, but his declarations of love for her during their chats are chipping away at my love for him. I have even been wishing misfortune on him because of my emotional pain. I do know one thing for sure-i have threatened both of them with death if my heart gets broken, and i still mean it-if i cant have him to myself,no one can. I just havent mentioned it lately because he wants to argue to change my mind & it aint gonna happen, so, im keeping my opinions to myself from them for now.

I know I cannot even begin to imagine how you must feel - however: If you imagine for a moment, she's here, you report her, she gets deported. What will it be like between your husband and you? Will he say "oh, well" and live happily ever after with you? How will this revenge affect your karma, your soul, conscience or whatever you believe in? Whatever you do - try not to do anything that you will regret for the rest of your life. All I can say.

All you can do is provide proof, if you have any, that she plans on committing immigration fraud. Her applying for a tourist visa is not proof of anything. If she manages to come to the US and applies for asylum it is up to the US government to determine if her case if valid or not.

You cannot get her barred or banned from the US. All you can do is provide proof of fraud.

I have read about people having affairs & there is not a happy ending for the guilty person in that situation. I still say if I can't have.him, no one can

1. If you have objective proof of fraud, contact the appropriate consulate with it.

2. If the other party reaches the U.S. regardless, take your proof to a USCIS FDNS officer.

3. You should probably discuss this with an immigration attorney and a divorce attorney.

4. If your situation is dissatisfactory, change it or get out of it.

5. If your situation is dissatisfactory but you can neither change nor get out of it, no one can help you.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
