Tourist Visa Wife Deported After Honeymoon Cruise

I give you two examples from my own life:

- I will likely be in El Paso while waiting for AoS. I would like to be able to walk across the border to Juárez/Mexico for the day.

- Shortly after my arrival, my (then) husband will travel to Peru for work and I would be happy to tag along.

I can understand the honeymoon to some extent as well ... although I am not too keen on a cruise.

I am not yet in the USA, but I already feel suffocated by the prospect of being unable to leave the country (or rather leave, but not return). If you live in borderless Europe, where you go into other countries all the time without even stopping your car - it's a weird and unpleasant thought.

well, nice thread hijaak, but your situation has huge merit, lets see, aye?

1. you are coming in on a K-1 visa, right? can go in/out of USA during the AOS process whilst holding the AP card, and not before. you probably think that your VWP status will help you, but at some point, USCIS will see the exit out of the USA and trigger an abandonment of the AOS casefile. Walking out of USA is no problem. Walking INTO the USA a huge problem for you, even you try VWP entry, as there's an invalidated K-1 visa stamp already in your passport.

2. Peru? you have AP, this is no problem. VWP entry after K-1 visa entry, not many CBP goons are trained for that.

borders vs borderless - you really need to examine your legal presence here, the I-94 and what your legal status is between filing for AOS and AOS granted, as I sense you are setting yourself up for some problems based on your personal calendar.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

No hijacking intended!

I am not actually going to leave the US - I just wanted to give some examples why people MIGHT want to cross the border shortly after marriage.

So my personal calendar is very simple: arrive - get married - wait and stay - wait and stay - AP - yippee - GC - even more yippee

in europe u dont need a passport to travel we can travel with our ID.. but US has their own laws unpleasant but that's how it is. I have a friend in Canada she got deported and her husband is active in US army ..and she get's no special treatment.. and geez!! is Canada i mean right there Canada!

She overstayed her student visa and got married and somehow when she applied for 130 the officer at the interview told her she needs to go to canada to apply for her 601 and she was never able to get back in.. so she is waiting there for 2 yrs.

There is law that was passed I think year or two ago, that spouses of Active duty cant be deported.

Funny they say "Immigration Services" not the USCIS or US government. They were stupid and well on VJ they ain't getting any tissues out on us. NO Mame.

Play by the rules or go home. Now you can file the correct way. That's what you get trying to adjust status on a Visitor Visa. Man not everybody but some do get caught and good.

Then you should have married and filed the appropriate Visa type for your situation. You have no choice but to file for AP and wait. Do not leave. Please don't leave until you have AP in hand okay. :goofy:

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
