I see you are kinda getting answers all over the place, but yeah, without knowing your area you won't get good answers. And of course, your fellow VJ'ers can't get the info that you wouldn't be able to search on your own. So for the child's public school, you are good. Enroll him as soon as possible and talk to the school that he will attend (based on which school district your address find's itself in) and ask about special needs requirements and programs. You will need to be informed about special transportation assignments and there may be additional options as well. A best friend of mine has a young son that is legally blind, and he gets special therapy from the school about three times a week to help him learn how to read on the enhancing equipment. You never know what's out there! Don't limit yourself to only the school - there may be other health and social programs available regardless of immigration status.

As for the college, you are more limited. He should be able to register as either a resident (often lower tuition) or out of state resident (often higher tuition), but he should be able to avoid the international student tuition (crazy high tuition). Try just applying and enrolling him in the local community college with just his US id card or drivers license. (I was able to do this when I moved into district to my community college, but was thinking I needed to prove district residency for at least a year. The year is a requirement, but I guess the license was enough.)

While I would encourage you to look into scholarships, he would not be eligible for federal loans (FAFSA) until he becomes "an eligible non-citizen"; which is "U.S. permanent resident, with a Permanent Resident Card (formerly known as an Alien Registration Receipt Card or "Green Card”) OR Conditional permanent resident (I-551C)". After you AOS, you may find yourself waiting for these things.

What we plan on doing, is enrolling him in US government and history classes, then some math classes while we wait on his foreign transcripts to be evaluated. He shouldn't need an SSN, but it will be easier to get that to the college come tax time and you need the Form 1098-T for the tuition you paid. As you wait, if he wants to attend a university later, apply soon after beginning community college. I just say that because if you apply to the school he wants, then they can begin the evaluation process too, and if any classes won't be accepted, he can take those at the college while you two wait for the conditional green card to be eligible for federal student loans.

There are multiple financial aid sources to attend college in US...

1) Scholarship based on academic or other talents like sports, music, science, etc.

(granted to exceptional or top students)

2) Financial need base grants based on family income

(mostly available to family income of $60K of less)

(if under 25, they will look at parent's income as well)

3) Federally subsidized work study program where school guarantees so many work hours per week

(they pay minimum wage to about $15 per hour depending on the job)

4) Loans

(through FAFSA, you can get some government backed loans,

or simply go to a lender and can get a private loan)

That said, much of these benefits are mostly available to USC or GC holders only.

As a non-USC and non-GC holder, above options may hardly apply.

Lastly, like everyone has mentioned, you really need to schedule an appointment

with financial office with the interested college and get all your questions answered.

Statements I made above are generic and each school has their own policies

including whether he can enroll in degree programs while waiting for GC.

My wife has EAD, and is waiting for GC, and pretty much nothing is available

in terms of financial aid, other than paying out of pocket or getting a private loan

with my co-sign.

Do you know if you have to get the CXC Transcript from the head office in Barbados or you can get it from the school you sit the exams?

I had to get them twice- 1st time I got them from the school. I was in NY and they aren't strict on official/unofficial transcripts.Second time I was in FL- they are really hard on international students in my area. I had to get them directly from CXC office in Barbados. Wouldn't accept them from my previous college or my high school.

Someone mentioned something you need to be really careful with- avoid ending up being classified as an international student. In my experience as soon as they see an international high school diploma they try to route you into that office which complicates things.

Does anyone know if he would be eligible for scholarships or financial aide? since they are not allowed any other government programs on K1? What about his minor son. will he be able to attend a public school although he is disabled? he is 8 with cerebral palsy but has cognitive functioning.

You have to look at the specific college requirements and rules. For us, my husband was able to start classes immediately paying in-state tuition since I had been a resident for the requisite year in my state. My husband was able to qualify under my residency for in-state tuition. As far as financial aid, unfortunately we were not able to qualify for any federal government aid (pell grant, even federal loans etc) until he has his Green card in hand and is a full permanent resident. They would not accept proof of AOS paperwork to give him financial aid of any kind. As a result he's taking classes at the local community college and we're paying out of pocket for each class. Community college is cheaper ($161 per credit hour) but it still adds up quickly!

Private scholarships he would have to apply- reach out to the college's aid office and see what his options would be. Don't count on federal aid- you have to be a permanent resident for that. Maybe school specific scholarships?

contact a few evaluation services and ask if they will take the unofficial with the seal. You might get lucky. Also try different schools in your area. New York did not need official transcripts.

ya, sorry, my answer wasn't so focused. I take another stab at it.

For a human in your fiance's exact 'timeslot' - ie - A K-1 visa holder (might be married, might have filed for AOS) there are some hurdles to go to college or university quickly.

First one, is status. The exact status you mention, that's a hard one really. If you are seeking federal funding, well, he has to qualify to receive it, firstly vetted at fafsa.gov . Without an EAD (or is it a green card now?) he cannot qualify. Then there is the tuition rate, resident of the state versus out of state tuition versus international student rate. Only the college or university can answer that one for you, for that timeslot. In Texas, to be declared a resident for in-state-tuition, ya gotta be inside o Texas for 1 year. other states have this 'married to usa citizen who had state residency for a year' rule. It varies.

Second, there is 'acceptance of high school diploma' - and this is usually handled by the international student office. You probably have country-specific requirements for getting the coursework certified or the diploma certified back in your fiance's country. Look into it before he leaves his country, back at a university in his country, at the admissions office there.

Third, there is the 'acceptance of prior college-level coursework' for any transfer or equivalents, and you have to go by the rules and methods utilized by the international students admission office at the college or university in the USA that he wants to apply.

Fourthly - there may or may not be a TOEFL-Test Score requirement.

Fifthly - there may or may not be an ACT or SAT test score requirement.

Many 2 year schools that award certificates for technical training are not so strict about what is what. Schools that award a 4 year degree are strict, and will give the student, sometimes, up to a year to handle any deficiencies uncovered during the admissions process.

If it makes no financial sense to attend university for the fall term (residency issues, green card issues, etc) then my small suggestion about gardening may have some usefulness - I'm a big fan of acquiring a plot of land (free, lease or co-op) and set up a vegetable garden, grow as much vegetables as possible on 1/2 acre plot. Then you (the USCitizen) sell the crop at a weekend farmers' market nearby.

So, with all of these variables to account for, you really need to learn what is what in your locale. It's different across each state for admissions rules, but the federal funding is fixed, there's no way around the vetting process done at fafsa.gov .

Ugh! So disheartening to know that you can't go to school and apply for a student loan while waiting for the work permit/green card. It would have been such a perfect time to acquire/expand skills so when the work permit arrives, you'll have added qualifications to tackle on the job market. :(
