Good Morning,

My husband came to the united states in april on a K1 visa. He has a 13 year old son who is of Haitian decent (father) and Dominican decent (mother). My husband has full custody of his son but did not bring him over to the usa with him due to financial constraints but had always planned to bring him within months. His son is staying with friends in the Dominican republic but since the violence has broken out we are trying to get him here quicker. Would we be able to get him here as a refugee? Anyone's help would be appreciated.

As far as I know as of right now they are not considered refugees so I'm not sure that would apply in this case. I wish you the best of luck though and hope he can come here soon. The situation in the DR isn't good and I hope it continues to receive international attention until something is rightfully done. Out of curiosity does the son have a Haitian passport or a Dominican passport? I also wonder if this matters in this case.

It's been less than a year since your fiance came over, you should be able to do a follow-to-join.

I assume the son was mentioned in the father's visa paperwork?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
