At what point in the I-130 process does the petitioner need to be a US citizen?

Assuming he's an LPR now, he could file for you under F2A (spouse of a permanent resident) now and then upgrade to an immediate relative petition after his oath ceremony to become a US citizen.

At what point in the I-130 process does the petitioner need to be a US citizen? In other words, could my spouse, who is weeks away from becoming a US citizen, began filing the I-130? Any help is appreciated.

Hi,

As an LPR, your spouse can file an I-130 for you. US citizenship is not necessary at any point.

Your spouse can file now as an LPR and upgrade the I-130 when he/she becomes a US citizen. Alternatively, your spouse can wait for US citizenship and file afterwards.

Sorry, I should have specified.

I'm a US citizen, and I petitioned for my spouse, who has been a permanent resident for 3+ years now and will shortly become a US citizen who wants to submit a I-130 for a family member. Just wondering if one has to be a US citizen at the time of filing the I-130 or only by the time the person gets an interview, etc. Thanks again for the help.

If petition is USC-dependent, should be USC as of signing the I-130. USC proof is part of the package, or risk denial.

December 8, 2010: Wedding date set; it will be on February 18, 2011!
