How to not lose my valid US driver's license

I didn't know you never advised them of your move. Your maiden name remains legal, that's why I suggested you wait.

Doing an address change was kind of the last thing on my mind when I had to leave my fiance after living with him for a year and start the whole fiance process... And considering I've been in the states pretty much every 3 months, it didn't feel like much of a move.

Expat1,

The "illegal" issued was mentioned by the OP in another forum in which she asked the same thing and I told her to keep her license as it is. She told me NO since it is illegal to do so, I told her it doesn't make sense to be illegal but I guess she was just being concerned about doing things the way she believes is the right way.

If this person is no longer enrolled in US school, and is back in home country,

if so...then I'm not 100% certain,

but I bet the DL that was issued under the valid F1 visa is invalid.

And on VJ site, you can't suggest/encourage anything that could be "illegal".

First two were on J1, this one I got through my F1 visa. I've been out of school since 2013 and in 2014 cops ran my license without issues so I think I'm good.

I think that's only because the VISA and DL databases are separate.

If your F1 visa is no longer valid, then I'm pretty sure the DL that was issue under the F1 visa

is technically invalid at this point...regardless of whether police can easily determine that or not.

To not risk any future complications with your permanent stay at US,

even if it's a little bit of hassle, I think doing things the right way is my recommendation.

The top part you quoted has nothing to do with the topic. That person is hung up on me saying it's illegal not to change your name on the driver's license. I know I was wrong (sounded weird to me because here your obligated to do so to not get into trouble) but the person can't drop it.

I doubt my driver's license is going to jeopardize my stay in the US. I've never heard of that happening. If you've seen a case like that, please send me a link.

I'm not 100% sure on your validity of DL that was issued under F1...like I've mentioned.

So it's OK for me to be wrong...and it just comes down to you making the sounds decision

for your situation.

When I gained US citizenship, I automatically lost my Korean citizenship because at the time

they didn't allow dual-citizenship, and that technically made my Korean passport invalid as well,

even though it had some time left on expiration.

If I were you, I would call your local DMV and find out...

1) Whether your current DL is really valid...(and not just rely on cop ran the check OK)

2) And how much grace period you have to change your last name.

Depending on the validity of your DL, driving while having no valid license could cause some headache...

Take a look at this example in Texas.

http://www.legalmatch.com/law-library/article/driving-without-a-license-in-texas.html

Now days...all sorts of records are kept online and follows you forever.

It's probably in your best interest to find out the exact details from the direct authority (DMV)

and make correct decisions accordingly.

Good luck.

I don't think you can compare it to citizenship and passports but I do think you might have a point my DL is not valid and I'll look into it! At least it wouldn't be in Delaware but I don't know exactly how it works here in Virginia. I'd assume it's the same.

My passport example above is an analogy to show you that

unexpired date on a document doesn't always make it valid.

If the DL's validity was strongly tied to the F1 visa,

then there is a high chance that it could be invalid...regardless of

how much time is left on expiration date.

It's best to know the true legal facts, and make proper decisions accordingly.

I agree with Duality here.

There are several issues going on-

One is the name change- When a woman gets married she has the option of assuming her spouses last name. She can present her marriage license to the DMV at any time and have her last name changed. Same thing for Soc Security, same thing for passport, GC, etc. There is also nothing wrong with having a mixture of documents - some with your maiden name and some with your married name. They are both your legal name. As someone said before its an alias or an AKA (also known as) etc.

Because each specific piece of Identification above (passport/GC/SS card etc) is issued by a different agency with its own hoops to jump through to get issued and what not- what you do to obtain them varies.

FOR A DL IN VA-

DL are issued based on how long you are legally auth to be in the country. So if your i94 or NOA says 1 year, you will get a DL for 1 year. The Ops original post where she speculated that if she presents her soon to be current paperwork with an expiration date of 1 year will cause a new DL issued with a date of 1 year is CORRECT>

The second issue here is that the OP currently has in her possession a DL that was issued based on her previously having a longer period of auth status in the country. It has since been shortened since she changed visa classes. Her address has/will not be changed.

I also feel the proper thing to do is to notify the DMV upon arrival of the new current immigration status and have it corrected solely based on the fact that the DMV issues DL based on how long you are legally auth to be in the country.
