I assume you are a greencard holder? If you maintain ties to the USA and stay just under a year, you will probably be ok, but having a re-entry permit would be safer, in case you need to stay a bit longer or if immigration upon re-entry argues you have abandoned your residence.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Highly risky.. 1-yr overseas risks a cbp perception of abandonment and a possible grilling at POE.

With the condition of the USCIS (read news, recent posts) it is extremely risky to be away from the USA for that long.

I would not allow my wife to do it, but, come to think of it, she would not want to do it. She is almost an American citizen, and wants to live here. It is why she came. And me.,.hahhha!

That's what's so befuddling.. why bother with LPR status if there are doubts about maintaining it? Asking about it in advance suggests lack of an emergency, which is typically the primary exception.

hi Everyone,

This question is actually for my filipina friend, and yes she is a greencard holder ( 10 years ) and she is actually due for citizenship next year. Her husband will be deployed overseas for 1 year and so they've decided that it would be best for her to go on vacation back home since she had not been back home for 6 years plus it would help much on her situation having 3 kids ( youngest is only a month old ). They are about to leave next week and when I asked her if she filed for a re-entry permit, she had no clue what it was. So, I am not sure if it will affect her residency or not. I know it will affect her filing for citizenship ( which she didn't know it will ).

Question- can she file for re-entry permit while in the Philippines?

This appears to answer all the questions and concerns, and to echo above she should file for a reentry permit. The fact she has no clue what it is doesn't exempt its validity in her scenario :)

No. She has to be physically present in USA when filing her application for re-entry permit.

She can leave afterwards but its better to stay till she gets her biometrics done.

She can ask USCIS to send the permit to a consulate overseas (you can say so on the application somewhere)

Question- can she file for re-entry permit while in the Philippines?
