Timeline

It has been since april15 when i got notice of NVC receiving my sons iv package. All fees paid all forms mailed, anyone else taking over 60 days. My son has already turned 21 we are so scared and worried it will drop his status from minor to adult... worried sick!

If he has relief under CSPA then his CSPA age was frozen when his priority date became current.

How do i know if he has relief under CSpA? What do you mean his priority date became current?

You can use the following calculator to see if he is eligible to retain classification as a minor under CSPA: http://lmgtfy.com/?q=cspa+calculator

The "Visa Bulletin Current Date" is the date (typically the first of that month) when his priority date became current. Since he is applying under the F2A Family Preference, since these are numerically-limited, he must wait in line for his priority date to become current before his application can proceed; clearly you've already reached that point since you've been communicating with the NVC.

Simpler: look at the I-130 receipt that was filed for the son. What is listed as the "Priority date"?

- Priority date (2/5/14)

- Approval date (whatever date his I-130 was approved by USCIS - this will be on the I-130 approval notice)

- Visa bulletin current date (best guess - 10/1/15)

Plug those in and see what it says. Basically, as the child of an LPR then under CSPA the time his I-130 was pending with USCIS will not count against him. So basically, the longer the I-130 was pending with USCIS, the better.

I have sent AOS as well as IV package i have paid all fees upto date, this the last i heard from NVC17-APR-15

Well unfortunately he's about three months out from his priority date becoming current, so it's not possible to tell precisely using that calculator.

If you want a ballpark guess, use the following on the calculator:

- Date of birth.

- Priority date (2/5/14)

- Approval date (whatever date his I-130 was approved by USCIS - this will be on the I-130 approval notice)

- Visa bulletin current date (best guess - 10/1/15)

Plug those in and see what it says. Basically, as the child of an LPR then under CSPA the time his I-130 was pending with USCIS will not count against him. So basically, the longer the I-130 was pending with USCIS, the better.

i dont understand it,should i get a lawyer involved cause im about to hypervent,this making me so worried.

Oh God! Thats so unfair, he 3 months away.....tears are pouring out now!
