My husband is the petitioner for his mother. We got an interview date in July and the NVS only has 2 of the 9 pages so they asked for her to bring it with her to the interview. My husband makes over the threshold but we file joint tax returns so do we need to still file the I-134A form as my name is on the tax returns as well? I read through the instructions but not clear on it. Want to make sure we do it correctly.

you are referring to the 864a I'm assuming and it's not mandatory because you file taxes jointly but you are more than welcomed to do so if you choose .

Make sure to fill out entire I 864 by your husband and sign it(original sign required photocopies are not acceptable). You should fill out I 864 A as you are also on his taxes(just to be on safe side). All forms need to be original. Attach 2014 tax return copy with that because lot of time Indian consulate ask for most recent tax returns. I know few people whose I864 was rejected because they send photo copy and original signature was not there. It is legal contract document so it needs original signature.

04/01/2015 - I-130 Approved

04/21/2015 - NVC received Case

04/29/2015 - DS261 filled

05/02/2015 - Case under CSPA review

06/04/2015 - Supervisor review Initiated-Wait 42 days
