Receipt date february 3, 2015

Notice date: april 16, 2015 : i-130 APPROVED

My PD written in my notice is january 26,2015.

What will happen next? Please enlighten me?

Yikes you losing time here read the NVC process provided. Hope you have everything ready.

Also why do you have Adjustment of Status pendind on your profile? Can you update plz. It's confusing. Or are you adjusting status?

Oh yeah i put pending coz i filed i-130 and i485 same date but different address, the i-130 was approved but the i485 sent back to us coz the reason was my priority date not current. We should have filed it together on the same address instead ??? now im so confused on what to do next, BTW i came to US on a tourist visa aug. 2014. My boyfriend then decided to marry me dec. 2014. And my visa already expired since 3rd of feb 2015.

Correct me if I'm wrong but I didn't think you can adjust status as an overstay if married to an LPR?!?!

Also, you've posted in the CR/IR-1 forum, which is for married people where the foreign spouse is in their own country awaiting their immigration visa. If you're atempting to adjust status, you should post in the adjustment of status forum.

Since the petitioner is a Green Card holder, you cannot adjust status because the priority date is not current. Furthermore, visa overstays are not forgiven for relatives of Green Card holders.

You never had a basis to adjust status in the first place because your petitioner is a GC holder which is not the same as having a US citizen spouse. To make it worse, you overstayed your tourist visa.

When is your spouse qualify for Naturalization?

if you leave now, you won't have a re-entry ban. You will need to wait in your country until the priority date on the petition becomes current, once that happens, the visa process can continue.

So i will be banned here in US if i didnt go back to my country?? Oh god My situation is so complicated ? i have a child born here on feb. 2015 he's only 4months old and nobody will take care of him if ill go back to my country coz my husband has work ??? what do you think is the best thjng to di with my case?
