Maritial Status on Beneficary Passport

Hello VJ members

I would like to get clarification on a matter w.r.t to my wife passport.Her current Indian passport shows her as unmarried status but her PCC show her as married. Should we get a new PP and do the PCC process all over again or should we stick with what we have right now.The Delhi Embassy has this to say as a response to my query a few days ago..

In response to your question, we would like to inform you that you may apply for PCC and attend the visa interview with the valid, unmarked and undamaged passport. Further, it is at the discretion of the applicant whether to re-apply for the passport or not.

And, if you have already applied for a new passport then, we would request you to send the scanned copy of both passports and DS-260 confirmation page with all the applicant and petitioner details, so that we can forward the details to the concerned department.

We hope this information is helpful to you.

In my opinion this is their way of covering their behinds kind of response plus it seem like a ambiguous response.My worry is that it may set us up for a rejection at interview.

Marital status on the beneficiary's passport is irrelevant, only the marriage certificate matters.

It is best to update the passport with spouse's name. It is good to have a lot of evidence for interview. You can apply the spouse name update under Tatkal and it would take only couple of days to receive the updated passport.

Changing one's name is a personal choice that has no effect on the process whatsoever.

Not a factor at the interview! A legal marriage registration certificate is what counts.. a copy of which you likely sent to uscis\nvc.

A passport and Police clearance certificate are two different things. Secondly, passport offices in India, normally, don't issue PCC to a beneficiary until beneficially update her marital status with them on the passport. So its only applicable with female-beneficiaries AND only for obtaining PCC. It has nothing to do with the process, more proof of marriage or anything else. Don't know if beneficiary here is a male or female, but regardless you have already obtained PCC then there is nothing to worry about. PCC is just a police clearance certificate and it is not a proof of marital status.

And the statement from Embassy that you quoted then its true for everyone worldwide because if someone obtains a new passport then the copy and detail of new passport must be given to US govt. Just don't worry too much at this time. You have got PCC and you already have passport even if your passport doesn't show your marital status. Good luck.
