She got tazed for acting like a d-bag, and being a completely uncooperative, blow hard know it all, telling the officers what she would and would not do. And refused even the simplest commands.

She was stopped for appearing nervous and refusing to allow her trunk to be checked. Not for being a college student. Her video is a textbook example of how to turn a brush with law enforcement into a situation that you will eventually earn yourself a bad outcome. Big Payout

there are different regulations and rules and laws inside of an immigration control check-point, and this type of inspection area goes by 'those' rules, not the ones you are alluding to.

See Tbone's post. This was not a primary border checkpoint. In reality they are only supposed to be verifying her immigration status.

You still have a right to refuse a search, hence the reason the dog was called. The fact that the guy said she could leave shows they really didn't have any suspicion as you would not allow a potential criminal to leave the scene if you really think there is contraband in the vehicle.

I was of the impression these internal border checkpoints are to intercept illegal immigrants, alien smugglers, contraband, fugitives, and...? So anyone and everyone is suspect, right?

Their original intent was just to grab smugglers and immigrants who may have snuck around the border crossing. Clearly the Supreme Court gave them an inch to do this. Now they are taking a yard by using it as a proper police dragnet for everyone.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Especially when you act like a complete d-bag. I have dealt with over eager police officers and I can assure you that the gal brought this upon herself. I would rather sue for an illegal stop and search than police brutality any day of the week.

Not agreeing for the police to stop you for no reason , demand your papers, detain you for no reason and search you for no reason is patriotism

I simply personally see it as she filmed enough of herself to lose a brutality suit. I am sure getting tazed sucks but I don't see huge dollar signs in her future. Had she been filming herself being compliant with the officers and still getting tazed different story.

That may have been the case up to the point where he told her could leave. At that point, I don't believe he had any right. She was off the road near her car and she no longer was required to get back in her car as he was requesting initially. Actually in that situation you may not want to reenter your car as the minute you open the door they can start to peak inside if they want without a warrant.
