Timeline

We are planning to apply for vaccination waiver for our son due to medical reasons. Will that fall in as "moral"? There is no medical option for not taking vaccination. ALso can you apply for waiver before consular processing time has come? Thanks in advance for your response.

Hey I am so sorry I didn't see your message earlier! I only get a notification to my Email when I receive a private message. I don't know if you have already gotten your answers but no moral does not mix with medical reasons. Medical reasons would be being allergic to ingredients in vaccines etc. Moral is because you are morally opposed to them. You can file a waiver for 1. medical , OR 2. moral, OR 3. religious reasons. They do not mix.

You have to wait until after the visa interview. They will send you a letter afterwards telling you that they won't issue you a visa because you do not have the required vaccinations. THEN you can send the waiver. You should have the waiver READY by that time instead of starting to prepare it to though. So you can speed up the process.

I can tell what your opinion about vaccinations is by the message you sent me and you shold definitely go fo religious grounds. If you still need my help send me a private message.

Hello everyone,

Was doing the step by step guidelines for I-130 and I-485, we will be including the I-601 waiver as well in the package, the guide says we don't need to include the fee for I-601 if filed together - can someone please verify this, we want to submit all the documents tomorrow.

** an I-601 is NO FEE, if, and ONLY if filed WITH an I-485. Later filing DOES require a fee. Whether to file an I-601 is an important decision -- like the J-1, consulation with an attorney is recommended.

Hey,

it would be new to me that you can file a waiver without paying the fee.

I know someone who went from a green card holder to a permanent resident and he had to pay the fee as well. He also included the waiver with all the other documents right from the start.

If you will send of the waiver without a check or money order the worst thing that will happen is that they will send the waiver back to you , with a notice saying you need to include a check or a money order. That happened to me.

If you are in some kind of a hurr I would include it just to be sure, if you do not have to pay it, they will send it back or destroy it etc.

I filed the I-601 before the medical & Interview, didn't realize needed to be denied at the interview first! USCIS sent a request for evidence of being denied, so we are going to do the medical & interview, get the notice of denial and sent that to UCIS as the evidence.

"An individual who is outside the united state may file form I-601 only if he or she has been found inadmissible by U.S. consular officer at an immigration visa or nonimmigrant K or V visa interview."

Just hope they don't make a big deal about the denial date being after the requested I-601 waiver date

I guess after the evidence is sent in and a decision is made, we will be told to reschedule another interview

I was supposed to wait till after the interview denial, before sending in the I-601. So they sent a request for evidence of denial. So going to due the medical & Interview and wait for the denial notice and send that to them

How long did it take you to get the notice of denial due to missing vaccinations at the interview?

Yes, exactly, you first have to get the visa denied before you send off the waiver.

For me...ughh I don't remember exactly but I would say not more than 10 days. After you go to the interview you are supposed to get your visa within 10 days ( at least in Germany) anyways, so for me i got my denial within those 10 days lol.
