hi everyone, my wife made a petition I-130 for me, finally after 11 months we r approved, today we receved a letter from uscis, the letter says:the above petition has been approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local uscis office to obtain fo I-485, application for permanent residency. A copy of this notice should be submitted with the application. If the person for whom you are petitioning decides to apply for a visa outside of the United States based in this petition, the petitioner should flirt for I-824, application for action on an approved application or petition, to request that we send the petition to the department of state national visa center. The NVC processes all approved immigrant petitions that require consular action, the NVC also determines which consular post is the appropriate consulate to complete visa processing. It will then forward the approved petition to that consulate.we have hired a lawyer to make our petition, but we have fired him few days ago, I m not in usa, I m in albania, my wife called uscis and spoke with a level 2 officer, she explained evrth to him, and he said don't rush to fill I-829 because maybe it's uscis mistake not the lawyer mistake.mistake.he suggest her to do a service request and he said we will get an answer in 2 weeks by mail.plz help me, has anyone had this type of experience? NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

hi

someone made a mistake, does your wife have a copy of the i130 sent? check question 22, the question that asks where will you have the interview

if there was a mistake and the i130 is never sent to NVC, then your wife will have to send the i824 to transfer the approved 130 to be sent to NVC

i had this same problem with my approval notice.

remedies (pick 1 or more):

1. have the petitioner contact USCIS via telephone, get an ISO, a Tier 2 human, and have the ISO correct it. Sometimes this is not a plausible solution, based on timing and where the casefile is, so

2. have the petitioner engage with a human in a Congressman's office (She has 3 congressmen available to her, 2 Senators and 1 Representative) . It needs to be a constituent liason that fills the desk of 'Immigration Liason Staffer'. The forms she needs are available online, and is best to

....a. call around first, talk with humans then

....b. print the form, sign the form, scan the form, fax the form out, email the form out with c.

....c. write up a longish email to the ILS human, include the scanned signed form as a file attachment, then email it all out to the ILS human.

....d. follow up the next day via telephone with the ILS human, asking them to GO FAST as USCIS still has the casefile in the A-File scanning section of the building and it must be rehomed to NVC shipping dock immediately.

Hi darnall, my wife once she read the letter from uscis she called the and spoke with a tie2 officer, he told her to make a service request, she did it, so he told to her to wait to weeks, becouse they will send a letter to her.her.on Monday we will contact the congress officer.do u think it will work Fast?

Hi darnall,we have involved the congress officer.he said that he is in touch with an officer in texas to see where the case is.he said that we will hear from them in 3 to 4 days.we called visa center just to see that maybe the case is in there and it wasn't anth in there.a tie2 officer said that sometimes the letters from uscis r standard and maybe the case is mailed at visa center.what do u think?

stick /focus on the Immigration Liason Staffer at the Congressman's office, petitioner using a telephone, having live conversation with that human.

The ILS Human can 'tell' the Congressional Liason Human at TSC that the approved I-130 petition must go to NVC for further Consular Processing, and the ILS human can tell the Congressional Liason Human at TSC that USCIS made a huge mistake, thinking the beneficiary was in the USA and was to go through an adjustment of status.

If'n the USCitizen Petitioner can actually have this conversation today, it's possible the casefile will get retagged by Monday, with another 3 weeks delay before it leaves the shipping dock to get to NVC.

i never mentioned to make a service request with an iso.

instead, the one pointed thing you were to determine with the iso was the disposition/routing of the approved casefile.

a service request never accomplishes that - instead, the iso was to actually look at the electronic record of the casefile, read the notes stored there, and determine the casefile movement based on what he/she read.

so, that phone call into an ISO, alas, was a waste of time for the uscitizen petitioner.

meanwhile back at the ILS human - the uscitizen petitioner really needs to use a telephone with the ILS human, insisting on the points that I wrote several weeks ago. Is there some communication problem between you and the USCitizen Petitioner? I ask, because the things you have written about since I wrote this stuff to you, is mind-boggling, indicative (at least to me) that the messages I wrote here fell on the floor, never communicated to the USCitizen Petitioner. If I'm wrong about it, so be it. But that's the way it's reading, at least to me.

Hi darnall, my wife made a service request because one of our friends told us to do that thing.she has contacted the congress officer imediatly as u said but nothing from him.now he doesn't reply anymore to her emails.do u think the infopass will be helpful? What do u suggest us to do? Please help us

use a telephone with the ILS human. it's summertime, find out if that staff person is on vacation or no. if on vacation, learn who is handling the liason to immigration matters, and talk with that person via telephone.

i'm sorry, in matters like this, timing is really important, and the congressman's office has to fully understand the problem in order to take the right action.

Hi darnall, please forgive me for my ignorance, what is ils human? U mean a level 2 officer? My wife called them again, she spoke with a level 2 officer, he said all u can do is open a service request,and wait 15 to 30 days,my wife told to the officer that this is the third service request that I open, the last time that I called u another tie2 officer told me that we will send to u an answer by email, but nothing happened. The tie2 officer told to my wife today that we never reply to a service request in 5 days.my wife spoke with the congress officer today again, he said I have contacted them 1 month ago but nothing from them, he said I have to give them 2 more months time.the reason why my wife contacted again the tie 2 officer is becouse one of her friends told her that has resolved this problem by service request.wrequest.we don't know what to believe,another person said that u have to start the process all over again.this congress officer isn't helpful at all

ILS = immigration liaison staffer - that is the individual who handles immigration matters for either the Representative or Senator.

If you haven't gotten anywhere with one particular staffer, try another. Everyone will have one Representative and two Senators.
