Hi all,



My husband received an RFE on his i-485 application over a month ago. It was for my W-2 form and we sent it back. According to their website they are still "reviewing" the mail we sent back.



Just today we received online an RFE for both the AP/EAD applications (71 days after they received these) and now have the dreaded wait of the letter explaining what they need from us. Of course I do not think we forgot anything in the initial filing but I must have.



Has anyone gotten an RFE on the EAD/AP applications? We filed these jointly with the green card app.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I checked the USCIS website earlier and we got an RFE for both AP and EAD... Did you get your notice? What was missing for you? I really don't see what we could have forgot...

Did you follow the VJ examples and use the correct code on the EAD app?

But you are correct, you will have to wait for the actual RFE letter. Post back with the actual reason.

Hi! We got our letter finally this weekend. It said processing is delayed now because he left the country while this is pending... Even though he never left the country at all! What happened is when he came here on the k1 visa it was a round trip ticket. So they recorded him as having left the country... A week before the date of the flight and after he had already cancelled it. It's a ridiculous system we have!!! So now he has to prove that he didn't leave the country. So stupid!!

I guess the message for the rest of us is to either book a return flight way out for when the AP will be through or just book a one-way.

How are you gonna go about proving he never left? Using the flight cancellation? Trying the get the I´94 corrected?

Hi TabeaK - It's such an annoying thing to have to go through now, on top of the long waits and thousands of steps and everything we've all been dealing with for the last year already. Meh!

We'll do exactly that - he's managed to remove the false entry from his I-94, and is meeting with an immigration officer tomorrow to show the cancellation record. Hopefully they can help him. There's something else about correcting some Freedom of Information Act piece but I'm not sure if that's necessary yet or not.

You know, when they sent the RFE, they didn't give any help whatsoever. They just said prove you didn't leave, and left it at that! Left us feeling helpless really - how are you supposed to prove that you're right here in the country opening up the letter they just sent? So this is taking some research and trial but hopefully all will go well now. Joke of a system we have!
