Pinay Mom being Deported brought her U.S. Citizen Son in the Philippines

i wouldnt think the extramarital affair alone would have gotten her deported.. I suspect there's more to it than just that. Dont get me wrong, extramarital affair is immoral I know. Just that, USCIS must have had a heavier reason than just that is all.. Y'al, please correct me if Im wrong..

Hi ,yeah you're right, it was a long story with felony, her ex wife was reported for assault holding a deadly weapon ,along with a big fight when my cousin proved all her wrongdoings..Sorry I didn't elaborate more..cause my main concern here is all about my niece..thanks for posting.

The child's mother is a Philippines citizen so surely the child is a Philippines citizen as well (in addition to being a US citizen). I don't know the laws of the Philippines but it does not make sense to me that the child could have "overstay" in her mother's home country.

I have two children born here in the US and I know for a fact that they are Hungarian citizens as well as US citizens by virtue of being born to me, a Hungarian citizen. I have not gotten their papers yet, but they are Hungarian citizens nonetheless, which is why I'll be able to register them as such in the future.

All you need to do is get the son his US passport, let the father come and take the son back on the plane back.

No one will say anyting believe me.

What about the overstay?

if the child born with a mother who is still Filipino citizen, the child automatic Filipino Citizen. Now the child is dual citizenship since he was born in USA. The child travel with her mother who is still a Filipino citizen so the child will not pay any overstay. You can only pay overstay if you are US Citizen traveling alone. Just get the child US Passport renewed in US EMbassy. Try to report the child birth abroad in NSO. You only need the approval letter signed by the mother permitting the child to travel with specific person who will fetch or travel with the child back to the US.

correction for my post before: if the child entering in the Philippines using US Passport he/she considered as foreigner therefore he/she has to pay overstay. The best thing to do report him/her as birth abroad so he/she can obtain Philippine Passport and to minimize the fine or avoid the fine and can stay come back to the Philippines anytime...

Once the report of birth is completed, the child will be issued a certificate of Philippine citizenship and will be eligible to apply for a Philippine Passport. Once a citizen, the fines are waived.

Yes, the child was considered overstaying since he is a U.S. Citizen and used his U.S. Passport to enter Philippines,.even if the mother is from there..Thank you.

The child is eligible for dual citizenship. Get that sorted out and then the won't be any overstay fees.

Then renew the child's US passport and allow him to return to the US.

What isn't clear is if your cousin approved of his ex taking the child to the Philippines. Was there any kind of custody order in place? If there was, these usually prohibit unapproved relocation of the child. The United States Supreme Court ruled that an order prohibiting the removal of a child from a country without the non-custodial parent's consent is enforceable under an international child abduction treaty, It is a messy and complicated path, but it might be one you could take....

The custody of the child was automatically given to the mother since the child is only 1yr old at the time , so he was a minor...I believe the child can only choose where he want to be with when the right age comes..Thanks for your reply,
