Pinay Mom being Deported brought her U.S. Citizen Son in the Philippines

Hi all.. this concerns for my cousin who had her wife deported back to the Philippines 8 years ago,her ex-wife didn't push thru with her GC since she was deported way back home due to immorality ..She brought back home their son who was born here in California..Their son's US passport has been expired and the child had overstayed in the Philippines for 8 years now..my cousin wants his Son back here with him with a mutual agreement with his ex-wife..How much will my cousin pay for his sons 8 yrs overstay in the Philippines and what are the process to take? We just can't find the answer in Bureau of Immigration in Philippines site.. I posted here in Vj, hoping that any member might have a similar case or experience..Thanks in advance for any insight..

I cant say whats the rules over there on the child for sure

but it would seem a minor (kid) would have the right to be with

mom in her own country especially since she has to live there

being a deportee from the US....I really doubt there are any

great consequences....The child passport can be renewed at

the US Embassy there. Seem she was deported for moral turpitude

I have no idea how much the BIA will charge for the overstay. Maybe the first year will be free because of the balikbayan privilege.

Only the BIA can tell you how much the fee for the ecc will be since they have a magical way of computing it that is unique to the child's age and other factors. A friend of mine had to pay 5,000+ for a 9mo old baby. Pretty steep. Another option could be applying for a PH passport tho I'm not sure that would work if she didn't register the child's birth abroad with the Phl EMbassy

Again, no one can tell you how much it will be.

The cousin cannot have someone deported for having an extramarital affair.

did she have a green card at all? ever?? her infidelity must have had a lot more weight to it, e.g. got pregnant with another man...

i wouldnt think the extramarital affair alone would have gotten her deported.. I suspect there's more to it than just that. Dont get me wrong, extramarital affair is immoral I know. Just that, USCIS must have had a heavier reason than just that is all.. Y'al, please correct me if Im wrong..

I had a hard time understanding the post, honestly with the use of pronouns. My grammar isn't perfect either, so in no way I am trying to correct yours. So here's what I understand:

Your cousin - is a male, a he, the US citizen - Correct?

the child - is a female, a she, also a US citizen - Correct?

I see you're also from the Philippines that's why I initially thought your cousin is the filipina wife who was deported.. This is for everybody else's reference who might want to comment on your post.. Please correct. Thanks

In theory the child should be eligible for dual citizenship. Was his birth reported to the Philippine consulate in the U.S.? If not look into getting that done.

Once he has a Philippine passport, the overstay, and any fees associated with, go away.

That's the short version.

The child is eligible for dual citizenship. Get that sorted out and then the won't be any overstay fees.

Then renew the child's US passport and allow him to return to the US.

What isn't clear is if your cousin approved of his ex taking the child to the Philippines. Was there any kind of custody order in place? If there was, these usually prohibit unapproved relocation of the child. The United States Supreme Court ruled that an order prohibiting the removal of a child from a country without the non-custodial parent's consent is enforceable under an international child abduction treaty, It is a messy and complicated path, but it might be one you could take....
