I-94 thinks I left the USA.....

Timeline

Went this morning to the local CBP office and had my situation corrected in about 5 minutes showing my passport - the officer typed something (I couldn't see the monitor so no clues) and commented that it is a very common issue with round trips; indeed the lady she spoke with before me had the same issue.

Now back to the forever wait for an answer from TSC..next week it will be one year from my AoS request, I'll buy a cake with one candle.

1 year? how will you know if ur case is in Tsc or Csc?

These situations are why, amidst the activity and excitement of arriving in the U.S., one should take the time to cancel the return flight by calling the airline, noting the time and date of the call, noting the name or ID number (or both) of the airline employee spoken to, and noting the cancellation number if one is given.

These notes should be filed securely with the beneficiary's other immigration papers. If the airline employee is able to generate an e-mailed cancellation notice, it's even better.

The above takes very little time but is extremely easy to forget to do.

I was able to cancel my wife's return flight on the airlines website (I purchased directly from the airline, FWIW), which you can then print out for confirmation. We used Lufthansa at the time.

I didn't - I don't think I will be called either since my Adjustment of Status is Employment based: they tell me there is usually no interview for that.

I have the same problem with my I-94. It thinks I left the country in March, but I cancelled my flight, and this still happened. I contacted my lawyer who said that this happens to a looot of people and that I should do nothing about it, and it will all be fine.

I decided that I wanted to verify the info and called the field office that redirected me to the CBP at the Airport, and the man there said that I'm out of status anyways, so it doesn't matter. And told me that they wont change anything regarding my I-94

So you lucky guys, that you sorted this thing out. But I actually have no idea what to do about it now

If I was you, I'd ignore the telephone call, find the nearest CBP office to you (I posted a link in this thread), take your passport, I-797 NOS'a and yourself to the local CBP office - so far as I know from this thread and the PM's I've received, no one that has gone to the office personally has been denied a correction.

I, too, and technically out of status - but by implication of my I485, I am still granted status until such time as a decision is made.

You have not stated if you are currently filing for AOS (or whatever applies to you). So your mileage may vary.

02-20-2015 - Went to USCIS Boston for biometrics; Arrived at 3pm, left at 4.30pm. Went smoothly & told I have "amazingly clear fingerprints!"

04-16-2015 - Finalized my response to RFIE; Response was over 120 pages, including 1 years bank statements from USA and UK.

05-21-2015 - Visited local SSA office to apply for SSN - All paperwork accepted and card will arrive 7-10 days.

08-14-2015 - E-mail received - interview is September 21 2015!!!!

09-21-2015 - Interview at Lawrence, MA - approved on the spot after just a few minutes.

09-25-2015 - Green card received with "Welcome to the USA" document.

Hello. Just out of curiousity, how did you cancel the flight? Did you cancel it directly by calling the airline? Or did you cancel it through an agency (in case you bought the ticket through an agency)? And how long before the date of your return flight did you cancel the return ticket?

Did they give you any reason for their denial to correct the records?

Just wanted to give yall an update.

So I came to the US on a K1 visa on December 6th, 2014. I had a roundtrip ticket because it was cheaper. I called Delta in February to cancel the return portion of my ticket. They cancelled it right then and there. Just to make sure, I called them a week ago as well and they confirmed that it is indeed cancelled since February. My return flight date was May 20th, 2015 (today), the flight left the US a few hours ago. I just checked my electronic I-94 and thank god my travel history did not change. ^_^

So my advice is to definitely call the airline directly and cancel the return portion as soon as you can. You don't wanna risk a denial from USCIS.

He literally just said, we don't do that here. I argued for about 10 mins to the point in which voices were being raised. He said it will not effect your AOS in any way and we know you did not leave the country, there is nothing we can do. He also said that USCIS check another in depth system that will have the fact that you were not on the airline manifesto. The conversation got pretty heated but I have done everything I can do. I have even filed out a form on this UA website to email me proof I wasn't on the flight

Whilst I truly feel your pain and anxiety, chances are USCIS will see it for what it is - a mistake! I also realize that you, like me, would rather sort it ahead of time, rather than risk USCIS needing to investigate it further.

In such an instance, politely but firmly insist on speaking with the Shift Supervisor. The other option is to visit a different CBP Deferred Inspection office.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
