I-94 thinks I left the USA.....

Hiya,

I'm mid way through AOS, and am right here in the USA. I happened to check my I-94 today, wondering if my AOS was showing on there - no idea why I thought it might, but I checked it anyway on the DHS website.

Obviously nothing about my AOS on there, but what I did discover is that according to the I-94, I left the USA on Jan 8 2015!!!!

My original departure ticket was for that date, but I did not get on the flight - I didn't even get out of bed ;)

Should I try to get this corrected; Will USCIS question this?

Why do they think I left the USA - but regardless, they are still processing my AOS, and just yesterday my I-485 changed status to preparing an interview.

Perhaps I'm just over cautious....

01-22-2015 - Received text message saying my package had arrived.

01-27-2015 - Mail received: 4x I797 NOA for I131, I130, I765 & I485)

02-03-2015 - Mail received: I797C, NOA for I485 & I765 - Appointment for biometrics in Boston MA is 02/20/2015

02-16-2015 - Mail received: RFIE for my I485 due to our unusual finances (we own a UK business, but do not work ourselves)

02-20-2015 - Went to USCIS Boston for biometrics; Arrived at 3pm, left at 4.30pm. Went smoothly & told I have "amazingly clear fingerprints!"

- Long delay in our response to RFIE, didn't know how to respond; took time to produce compelling evidence of our good financial standing.

04-16-2015 - Finalized my response to RFIE; Response was over 120 pages, including 1 years bank statements from USA and UK.

04-24-2015 - myUSCIS case status for I-485 updated to confirm receipt of my response.

05-12-2015 - myUSCIS case status for I-765 updated to "Approved" & case history shows "We ordered your card"

05-13-2015 - myUSCIS case status for I-485 updated to "Case is ready to be scheduled for an interview"

05-16-2015 - Mail received: I-797 NOA for I765 - Confirming my I765 was approved - valid from 05/11/2015 to 05/10/2016

05-18-2015 - text & email received, stating my EAD card has been posted today and should arrive within 30 (!!) days

05-19-2015 - EAD & AP combo card received in the mail

05-21-2015 - Visited local SSA office to apply for SSN - All paperwork accepted and card will arrive 7-10 days.

05-29-2015 - SS card received

08-14-2015 - E-mail received - interview is September 21 2015!!!!

09-21-2015 - Interview at Lawrence, MA - approved on the spot after just a few minutes.

09-25-2015 - Green card received with "Welcome to the USA" document.

I would check with the airline. If you were not removed from the passenger list then it will show you left the country. There are some other threads on this, do a search for them for some advice on what to do. It does cause massive problems and needs to be corrected ASAP. AOS will be denied if you do nothing.

Since you didn't cancel the return portion of your flight then the airline sent data to DHS indicating you departed the US, even though you didn't. As stated above, it will probably result in the denial of your I-485 if you do nothing.

You should contact the nearest CBP Deferred Inspection office, inform them that there is a mistake on your I-94, and ask for it to be corrected.

Did you cancel your flight? Got any proof?

Do you have anything to prove you were in the US on that date? Guess not since you didn't get out of bed that day.

If they think you left the US, they could say you abandoned your AOS.

Definitely contact a CBP Deferred Inspection Office to inquire about correcting the I-94 record. I wouldn't risk a denial from USCIS.

I came to the US on a K1 visa on December 6th, 2014. I had a roundtrip ticket because it was cheaper. The return date was May 20th, 2015. I have read many horror stories here on Visajourney about people getting their AOS denied because their I-94 said they left. So I called Delta and cancelled my return ticket back in February to avoid any possible trouble. I am very glad I did so.

Well Boston is my local office, they're just not open tomorrow! I'll call an office that is open tomorrow and see what they suggest.

Sigh.... After having my EAD approved yesterday, and getting an update today that my I-485 interview is being scheduled, it's awful to think it could all go wrong due to an error.

Well, I'm glad I stumbled into this thread..turns out my I-94 also says I left the States because the airline didn't take me off the passenger list when I didn't show up for my flight back to Italy. OK, it will be taken care of - but I am puzzled: how one gets his EAD approved when his I-94 shows he left the States? I though EAD too implied you were in the States.

I completely agree with you Erminio!!!! How has my application progressed so much since I "apparently" left the USA.

I do not know how serious this is, but I intend to call first thing in the morning to try and get this sorted.
