Question: I had a felony conviction from 15 years ago and there is a non extradition warrant (meaning if I return to that state I could be arrested). Aslo, I did have a DUI.

Do I need a waiver or how does this change my application??? Thank you.

were U sentenced....how long

were U a LPR

Do U have disposition & court papers on all cases

were U deported or VD

A good waiver atty will need to know all this and more.

You may even need a criminal atty to tie up stuff that's

unfinished. ask about vacatur etc (depending on state)

Liz Cannon is goo & does ph consults

Thank you for your reply. I had served three years on the felony conviction which was 15 years ago. I learned after moving out-of-state many years later that I had a non extradition Warrant. It means I would be arrested if I returned back to that state for the questioning or such pertaining to charge. I have a valid passport to which I've traveled with, a drivers license and there is no issues. I have good job and home and other investments and such in life. I just was not sure as the US citizen if these previous things would become an issue? If I have to get a waiver I would then have legal counsel of course address that issue and take over the rest of this visa case.

If U are the USC petitioning someone it must be disclosed (all your crimes)

Your fiancé needs to knows all details (proving relationship is real)

As the USC it will not prevent U petitioning ONLY if U had an AWA case

or this was the beneficiary(foreigner) background....good luck

Thank you!!! Yes I am the USC petitioning and my fiance (Beneficiary) is aware of the details of crime. There is NO AWA case and my beneficiary(foreigner) has a clear background. How do I disclose my past felony (crimes)?

**footnote I should have fought the charge back then as that I was young and did not have the legal support or money to pay for such and I regret it to this day. However, life goes on.

Have copies of disposition and court records available

don't wait for last minute

:ot: Now older and wiser have you ever looked into vacating/expunging

your sentence in your state to regain your rights to carry, vote

or did U plea out. Good luck on yor Journey
