Hello All,

I am wondering if any of you have or are going though this issue at the time. I have applied for my K1 Visa and was dinied since I left the US 5 months after I turned 18 voluntarily. I already went to Ciudad Juarez and had my physical and interview on June of 2014 and I was denied obviously. I then applied for the I-601 and we sent it and USCIS received in on September 12, 2014. It has been 8 months since they received it and we have not heard a single thing from them.

Does anyone know how long does this actually take? Our case was very simple. I was taken to the US as a newborn and spent 18 years in the US before I decided to go back to Mexico to continue my education but me and my high school sweethear stayed together. I never had any criminal records or any type of issues with any law enforcement of any kind. Never worked or did anything to cause trouble.

Our case was easy to prove since my fiancee is currently in college and the area I live in Mexico is really dangerous for her to live in and most importantly my fiancee suffers from a few medical conditions that would make it hard for her to move here.

We thought our case was easy and our waiver was really well put, but we have not heard anything since.

Can someone tell me or just give us some light as to what we can expect? We have been apart for three years now since I first moved to mexico and 8 months since we sent our waiver and it is really hard.

I just really want this to be over so that I can be with her for good. ;(

Call your local senator's office and ask them to do an inquiry on your waiver. Maybe you received an RFE but never received the notice in the mail. I've seen it happen several times on VJ.

But I have checked it online at uscis.gov and it still states that the case was received but have not seen any movement from there on. Plus, I am not wanting to call because I heard that if you call, they put your file all the way back which makes no sense but at this point, Im afraid to try.

Not true. They don't update the USCIS status online until they approve or deny. There are no updates. You have to contact the senator's office.

They also give very short ####### answers when you Call yourself. The senator's office is able to get detailed info.

Don't listen to negative rumors, the Senators get status update easier than

an atty at times, it was a str8 forward case but for many reason it could be

delayed , slow adjudicator, name hits etc was it a strong package? though

dealing with humans you will find some nit-pick at the teeniest thing, stay

positive, I also think they are a bit backlogged right now, tour day is coming

Yes it was a strong package and although the case was easy, we gather a lot of information and proof so that we could make the case easier to approve. I have not lost hope but it is becoming really hard because me and my fiancee's schedules are off and we barely talk at times but thankfully she will be coming down on June and I hope this is the last time she has to come down and hopefully we hear back from them as soon as possible. By the way, what is "tour day"? Do you know how long it would take for our Senator's office to provide us with an update once we call them for the inquiry? Thank you for the helpful info!

Our senator's office got back to us within a week. The beneficiary is the one who signs the release since its their waiver. The petitioner won't Be able to request information for the waiver. The USCIS is strict with that. it's not the same process as the original petition. I can't believe you waited this long to make an inquiry.

The proof you need for an I601 waiver is the hardship on the petitioner and why they can't live in your country. I feel like maybe you received an RFE and they are waiting for a response. The letter would go to your country. My husband received the notices in Costa Rica. The first thing you do today would be to call and make an inquiry with the senator's office. The waivers aren't taking a year ...they are getting backlogged but you filed a year ago.

I thought about that but I have not gotten a letter or a notification by emails since Im signed up to get the notifications by email too. I will still call the local senators office and see what information I can get.

The USCIS does not send emails. They send hard copy letters and some people NEVER get them. The text alerts are only good in the US. My husband never received an email or text from the USCIS when he was in Costa Rica. I'm trying to tell you that you can't rely on the USCIS to notify you

Okay I already told my fiancee of all this information so that I can get a call to our local sernator's office. And @Boiler, my waiver is form I-601 Waiver for grounds of inadmissibility becuase I stayed past 6 months after I turned 18 and I left voluntarily so that automatically trigerred the ban
