Timeline

Just wondering how would background checks, that are required in a lot of Job opportunities, works when you are fresh in U.S under the permanent resident status?

Any of you guys had an issue with this before, getting rejected because of not being able to get one for whatever factor?

I would think they'd still be able to do one, since you have a SSN, it just won't show anything. I think the bigger problem would be the credit report, which you need for creditcards, mortgages etc.

Dec 16th 2015 - Medical exam


Dec 21st 2015 - Interview


Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license

They can't background check abroad, so it would show very little.

I did not seek work for a few years after moving to the USA (had little kids), so this did not affect me, but I know several immigrants who gave their employer a copy of the police cert they submitted during their visa app.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Depends on the job and the type of background check they do?

FBI Background check?

OR just personal background check from a 3rd party agency......

Thank you guys for sharing your experiences.

VOL, I can't really tell which one they do. At least on the job description is not mentioned. I work with IT, don't know if that makes any difference.

I am just afraid that I am going to lose job opportunities over a background check, that is something I have no control over..

I think before I go I will just get a new police cert and show the employer just in case.

Require US citizenship isn't legal when you are under the status of "permanent resident" .. but well, what can we do if they do so? lol

This really depends on the type of job and the employer.

Any job dealing with money transaction (banks, real estate, investment, etc.)

and national security (CIA, FBI, DHS, etc.) will do pretty thorough background (and credit) check.

But there are many other jobs that do not do background check.

Don't worry. I am working in IT too. My thinking was same as yours. But it didn't give me any problem at all. I did clear all background check.

For background check, its fresh, wont show anything on you and most likely means you will get the job, The creditcards on the otherhand, allow upto 6 months for some activity to happen, to have this started, get your social security number and within 30 days, apply for Capital One bank credit card, they will give you 200-300$ credit and start your credit history.

What about you guys diplomas in IT, was necessary to do any procedure to make it valid in US?

Get it translated and stamped from your country Education Ministry before getting it to the US, this way it will equal the hours taken in your country and give you the chance to continue 4 years education plan. Wish you goodluck.

It is entirely legal.

Also, search the forum - there was plenty of people that were denied employments because their background check came back as probably empty (since it's being done against SSN and there's nothing there). It's a serious concern with not a whole lot of solutions available.

It may happen, but it is not legal at all.

Federal law says that employers cannot discriminate against you because of your immigration status. Employers cannot:

• Refuse to hire you, or fire you, because of your immigration status or because you are not a U.S. citizen.

• Require you to show a Permanent Resident Card, or reject your lawful work papers.

• Prefer hiring undocumented workers.

• Discriminate against you because of your national origin (or country of origin).

• Retaliate against any employee who complains of the above treatment. For more information about your rights, or to file a complaint, call the Office of Special Counsel at 1-800-255-7688 or 1-800-237-2515 (for hearing impaired). If you do not speak English, interpreters
