RFE K1 intent to marry

hi, everyone,

i just got my RFE letter this afternoon, it request nothing but just "proof of intent to marry"

i saw lots friends on VJ got the same request.

my lawyer didn't tell me that we need to submit this when we file the application.

1. so do i have to submit proof for both me and my fiancee?

2.and there is another page in the letter with the return address and question regard the G-28 form, which should i check?

3.can i mail it back overnight by using USPS priority express mail?

please help?

Hi, sorry to hear that your lawyer messed it up. But please be aware to hire an immigration lawyer, some of them really don't know about forms that should be submitted. Before to pay money make sure that he\she knows exactly what to do and has done it before.

1) Yes, there should be two short signed letters one from you, one is from your fiance that you want to marry each other within 90 day after her entry to the US.

2), 3) Sorry, I can't answer this question because we've never submitted this G-28 form, is it a form for RFE? If yes, then you can file it as soon as you get ready your "RFE"

If your lawyer didn't tell you about this basic requirement then you should fire your lawyer. It's also stated in the I-129F instructions.

The G-28 is a form which your attorney was supposed to submit together with your application. This form (must be submitted on blue paper) signals to the USCIS that you have legal representation and also lets them know that all correspondence should be sent to your attorney as well as you from the moment the form is processed. The USCIS issued a new type of G 28 for 2015 which is mandatory from May 2015 so your attorney either forgot to attach it or submitted the wrong one... or something else but basically it's up to them to send this to the USCIS. Just call your attorney and let them know.

As other have answered you and fiancee each need to fill out a "proof of intent to marry"

letter (dated & signed). I'm quite surprised that your attorney didn't know this.

So it begs the question on his/her knowledge on this matter.

Hope you don't spend much more money with this attorney.

i actually went to their office today, one of the partner is there but when she saw the RFE letter, she said she never handle this before, and she told me that she already in this business for more than 10 yrs.

i really mad at that point, it doesn't make any sense when she said she in the business for more than 10 yrs but never see this.

now i am doubt their professional.

I can not believe the lawyer did not know this about the application. We do not have a lawyer at this point. We put together everything we could possibly need in the document. It was 2 1/2 inches think. We put everything in even the no criminal record paper everything. Copies of course. I would recommend getting everything possible that the embassy will need, follow the instructions on the I129f. Now it is on its way to the consulate no RFEs. I agree get a better lawyer.
